{"data":{"id":"us-ky/krs-217.215","jurisdiction":"us-ky","citation":"KRS 217.215","heading":"Pharmacy board's powers as to drugs -- Regulations on prescription","body":"records and on refilling prescriptions in emergency.\n(1) The Board of Pharmacy, its agents and inspectors shall have the same powers of\ninspection and enforcement as the cabinet  under KRS 217.005 to 217.215, insofar\nas it relates to drugs in licensed pharmacies.\n(2) The Board of Pharmacy may establish regulations relating to the storage and\nretrieval of prescription records in licensed pharmacies, including regulations\nregarding computerized recordkeeping systems.\n(3) (a) No prescription for any drug may be refilled by a pharmacist unless authorized\nby the prescribing practitioner, except that, in emergency situations in which\nsuch authorization may not be readily or easily obtain ed from the practitioner,\na pharmacist may:\n1. Dispense up to a seventy -two (72) hour supply of maintenance\nmedication;\n2. Dispense greater than a seventy -two (72) hour supply of maintenance\nmedication if:\na. The standard unit of dispensing for the drug exceeds a seventy-two\n(72) hour supply;\nb. The pharmacist dispenses a supply of the drug that is equal to the\nstandard unit of dispensing for the drug; and\nc. The drug is used for insulin therapy or the treatment of chronic\nrespiratory diseases; and\n3. Dispense up to a thirty (30) day supply of maintenance medication in\nemergency situations as authorized by KRS 315.500.\n(b) Emergency refills dispensed under this subsection shall not be authorized for\nany controlled substance or for any drug which is not essential to maintenance\nof life or continuation of therapy in chronic disease conditions.\n(c) The Board of Pharmacy shall promulgate administrative regulations to carry\nout the provisions of this subsection.","path":["KRS Chapter 217"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49355","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:25Z","sha256":"b753ae614620a202093ee3e01d4ddbc670128388d8c73861eb853039abe781fe","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217.214","next":"us-ky/krs-217.216"},"notice":"GroundRules: Original legal text.
