{"data":{"id":"us-ky/krs-217.5401","jurisdiction":"us-ky","citation":"KRS 217.5401","heading":"Definitions for KRS 217.5401 to 217.5408.","body":"As used in KRS 217.5401 to 217.5408:\n(1) \"Biological product\" means a virus, therapeutic serum, toxin, antitoxin, vaccine,\nblood, blood component or derivative, protein other than a chemically synthesized\npolypeptide, allergenic product or analogous product, or arsphenamine or derivative\nof arsphenamine or any other trivalent organic arsenic compound, applicable to the\nprevention, treatment, or cure of a disease or condition of human beings;\n(2) \"Device\" has the same meaning as in KRS 217.015;\n(3) \"Drug\" has the same meaning as in KRS 217.015;\n(4) \"Eligible patient\" means an individual who meets the requirements of KRS\n217.5403;\n(5) \"Health care provider\" means a licensed physician, a licensed advanced practice\nregistered nurse, or a licensed physician assistant;\n(6) \"Health facility\" has the same meaning as in KRS 216B.015;\n(7) \"Investigational drug, biological product, or device\" means a drug, biological\nproduct, or device that:\n(a) Has successfully completed Phase I of a clinical trial but has not yet been\napproved for general use by the United States Food and Drug Administration;\nand\n(b) Remains under investigation in a United States Food and Drug\nAdministration-approved clinical trial;\n(8) \"Terminal illness\" means a progressive disease or a medical or sur gical condition\nthat:\n(a) Entails significant functional impairment;\n(b) Is not considered by a treating health care provider to be reversible even with\nadministration of a treatment currently approved by the United States Food\nand Drug Administration; and\n(c) Without life-sustaining procedures, will result in death; and\n(9) \"Written informed consent\" means a written document that meets the requirements\nof KRS 217.5404.","path":["KRS Chapter 217"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46071","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:26Z","sha256":"92d4de24a9a598ac262106dc9da7e439e432ef1a41079182e6719c2f559c63ff","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217.540","next":"us-ky/krs-217.5402"},"notice":"GroundRules: Original legal text.
