{"data":{"id":"us-ky/krs-217.550","jurisdiction":"us-ky","citation":"KRS 217.550","heading":"Prohibitions relating to distribution of pesticides.","body":"It shall be unlawful for any person to distribute within this state the following:\n(1) Any pesticide which is not registered pursuant to the provisions of KRS 217.542 to\n217.630, and to the provisions of FIFRA;\n(2) Any pesticide if any of the claims made  for it or any of the directions for its use\ndiffer from the representations made in connection with its registration, or if the\ncomposition of a pesticide differs from its composition as represented in connection\nwith its registration; provided, that in t he discretion of the department, a change in\nthe labeling or formulation of a pesticide may be made, within a registration period,\nwithout requiring reregistration of the product if the name is not changed and if the\nregistration is amended to reflect such  change and if such change will not violate\nany provisions of FIFRA;\n(3) Any pesticide, unless it is in the registrant's or the manufacturer's unbroken\nimmediate container, and there is affixed to such container, and to the outside\ncontainer or wrapper of the retail package, if there is one through which the required\ninformation on the immediate container cannot be clearly read, a label bearing:\n(a) The brand name and address of the manufacturer, registrant or person for\nwhom manufactured;\n(b) The name, brand or trademark under which the article is sold;\n(c) The net weight or measure of the content; and\n(d) Any pesticide in containers which are unsafe due to damage.\n(4) Any pesticide which contains any substance or substances in quantities highly toxic\nto man, determined as provided in KRS 217.542 to 217.630, unless the label bears,\nin addition to any other matter required by KRS 217.542 to 217.630:\n(a) The skull and crossbones;\n(b) The word \"poison\" in red prominently displayed on a background of dis tinctly\ncontrasting color; and\n(c) A statement of a practical treatment, first aid or otherwise, in case of\npoisoning by the pesticide;\n(5) The pesticides commonly known as lead arsenate, basic lead arsenate, calcium\narsenate, magnesium arsenate, zinc arsenate, zinc arsenite, sodium fluoride, sodium\nfluosilicate, and barium fluosilicate unless they are distinctly colored or discolored\nas provided by regulations, or any other white powder pesticide which the\ndepartment, after investigation of and after pub lic hearing on the necessity for such\naction for the protection of human life and the environment and the feasibility of\nsuch coloration or discoloration, shall by regulation, require to be distinctly colored\nor discolored unless it has been so colored or discolored;\n(6) Any pesticide which is adulterated or misbranded, or any device which is\nmisbranded.","path":["KRS Chapter 217"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9384","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:26Z","sha256":"93203379cda4b806b611d1bafea6e2a317d53faef5d5ac6aa776bab16acd15b8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217.544","next":"us-ky/krs-217.556"},"notice":"GroundRules: Original legal text.
