{"data":{"id":"us-ky/krs-217.565","jurisdiction":"us-ky","citation":"KRS 217.565","heading":"Registered pesticide with EPA -approved master label -- When warning","body":"deemed sufficient for purposes of duty to warn or label action -- Exception.\n(1) Any pesticide registered for use with the Department of Agriculture, pursuant to\nKRS 217.570,  or the United States Environmental Protection Agency (EPA)\npursuant to the FIFRA as defined in KRS 217.544, and any regulations promulgated\nthereunder, including but not limited to 40 C.F.R. pt. 156, that displays a label that\nhas been approved by the EPA  in registering the pesticide or is consistent with the\nmost recent human health risk assessment performed under the FIFRA shall be\ndeemed a sufficient warning label for the purposes of an action commenced under\nany provision of state law concerning the du ty to warn or label, or any other\ncommon law duty to warn.\n(2) This section shall only apply to any pesticide for which the EPA has approved a\nmaster label that includes an Agricultural Use Requirements label in accordance\nwith 40 C.F.R. pt. 156.\n(3) The provisions of this section shall not:\n(a) Apply when a determination has been made by the EPA that a manufacturer\nknowingly withheld, concealed, misrepresented, or destroyed material\ninformation regarding the human health risks of such pesticide in order to\nobtain or maintain approval of its label by the EPA; or\n(b) Be interpreted to prohibit a cause of action based on any other provision or\ndoctrine of state law.","path":["KRS Chapter 217"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57180","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:26Z","sha256":"f5060c98a6f4c4431cc025dff52c71eeabfb562c93c5ef26c4ee6c98dc606fe9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217.560","next":"us-ky/krs-217.570"},"notice":"GroundRules: Original legal text.
