{"data":{"id":"us-ky/krs-217.572","jurisdiction":"us-ky","citation":"KRS 217.572","heading":"Registration refusal, cancellation, suspension, and legal recourse -- Appeal","body":"of order -- Notice to EPA.\n(1) Upon certification pursuant to Section 24(c) of FIFRA by the administrator of EPA\nto register pesticides formulated to meet special local needs , the department shall\nconsider the following for refusal to register, for cancellation, for suspension and\nfor legal recourse for applicable pesticides:\n(a) If it does not appear to the department that the pesticide is such as to warrant\nthe proposed claims for it or if the pesticide and its labeling and other material\nrequired to be submitted do not comply with the provisions of KRS 217.542\nto 217.630 or administrative regulations promulgated thereunder, the\ndepartment shall notify the applicant of the ma nner in which the pesticide,\nlabeling, or other material required to be submitted fails to comply with the\nprovisions of KRS 217.542 to 217.630 so as to afford the applicant an\nopportunity to make the necessary corrections. If, upon receipt of this notice,\nthe applicant does not make the required changes, the department may refuse\nto register the pesticide.\n(b) When the department determines that a pesticide or its labeling does not\ncomply with the provisions of KRS 217.542 to 217.630 or the administrative\nregulations promulgated thereunder, the registration of a pesticide may be\ncancelled after a hearing that shall be conducted in accordance with KRS\nChapter 13B.\n(c) When the department determines that there is an imminent hazard, it may\nsuspend the registration of a pesticide by issuing an emergency order pursuant\nto KRS 13B.125.\n(d) Any person who will be adversely affected by a final order or emergency order\nissued under this section may obtain judicial review by filing a petition in the\nFranklin Circuit Court in accordance with KRS Chapter 13B.\n(2) If the department determines that the federally -registered pesticide with respect to\nthe use of a pesticide subject to this section within this state does not warrant the\nproposed claims for it, or if the pesticide and its labeling and other material required\nto be submitted do not comply with the provisions of FIFRA or the regulations\npromulgated thereunder, EPA shall be notified of the manner in which the pesticide,\nlabeling, or other material required to be s ubmitted fail to comply with the\nprovisions of FIFRA and suggest necessary corrections.","path":["KRS Chapter 217"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9389","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:26Z","sha256":"9ee7c5395c6e7cb3f33057cbabfaa725222647ee8b02673c21bb04e971bf91a1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217.570","next":"us-ky/krs-217.574"},"notice":"GroundRules: Original legal text.
