{"data":{"id":"us-ky/krs-217.670","jurisdiction":"us-ky","citation":"KRS 217.670","heading":"Construction of term \"misbranded.\"","body":"A hazardous substance is hereby declared to be misbranded when intended for household\nuse if it fails to bear a label:\n(1) Which states conspicuously:\n(a) The name and place of business of the manufacturer, packer, or distributor;\n(b) The common or usual n ame, or the chemical name (if there be no common or\nusual name), or the recognized generic name (not trade name only) of the\nhazardous substance or of each component which contributes substantially to\nits hazard;\n(c) One (1) of the following signal words: \"danger,\" \"warning,\" or \"caution\";\n(d) When necessary, an affirmative statement of the principal hazard or hazards\nsuch as \"flammable,\" \"vapor harmful,\" \"causes burns,\" \"absorbed through\nskin,\" or similar wording descriptive of the hazard;\n(e) Precautionary measures describing the action to be followed or avoided;\n(f) Instructions, when necessary, for the first -aid treatment in case of contact or\nexposure if the substance is hazardous through contact or exposure;\n(g) The word \"poison\" for any toxic substanc e which is defined as poisonous by\nthe rules and regulations of the secretary under the provisions of KRS 217.650\nto 217.710;\n(h) Instructions for handling and storage of packages which require special care in\nhandling or storage; and\n(i) The statement \"Keep out of reach of children\" or its practical equivalent;\n(2) On which any statements required under subsection (1) are not located prominently\nand are not in English in legible type in contrast by typography, layout, or color,\nwith other printed matter on the label; provided, however, that the secretary may by\nregulations provide for minimum information which shall appear on the labels for\nsmall packages, which labels need not include all of the information required by this\nsection; provided further, that the secretary may provide for less than the foregoing\nstatement of the hazard or precautionary measures for labels of hazardous\nsubstances presenting only minor hazards; and a package shall not be deemed\nmisbranded under the provisions of KRS 217.650 to 21 7.710 if it is a substance\nsubject to the Federal Insecticide, Fungicide, and Rodenticide Act (61 Stat. 163, 7\nU.S.C. secs. 135 et seq.); the Federal Food, Drug and Cosmetic Act (52 Stat. 1040\net seq., 21 U.S.C. secs. 301 et seq.); the Kentucky Pesticide A ct (KRS 217.542 to\n217.640); KRS 217.005 to 217.215, or to packages or substances intended for use in\nagriculture or horticulture for industrial or related uses.","path":["KRS Chapter 217"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9401","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:26Z","sha256":"5a9804a23d3ad27126027e4d2ef9c34210e654147b8ceb8a78c4cb22a4eadb23","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217.660","next":"us-ky/krs-217.680"},"notice":"GroundRules: Original legal text.
