{"data":{"id":"us-ky/krs-217b.080","jurisdiction":"us-ky","citation":"KRS 217B.080","heading":"Applicator's license -- Fees -- Aerial applications.","body":"(1) Except as provided in KRS 217B.090, it shall be unlawful for any person to act as\nan employee of a pesticide operator or dealer and apply pesticides without having\nobtained an applicator's license from the department. An applicator's license shall be\nin addition to any other license or permit required by law. Any person applying for\nan applicator's license shall file an application on a form prescribed by the\ndepartment on or before January 1 of each year. Application for a license to apply\npesticides shall be accompanied by a license fee of twenty -five dollars ($25). The\nprovisions of this section shall not apply to any individual who has passed the\nexamination provided for in KRS 217B.060(3), and is a licensed pesticide operator.\nIf the department finds th e applicant qualified to apply pesticides in the\nclassifications he has applied for after examinations as provided for in KRS\n217B.060(3), and if the applicant applying for a license to engage in aerial\napplications of pesticides has met all of the require ments of the Federal Aviation\nAgency and the Transportation Cabinet to operate the equipment described in the\napplication, the department shall issue a pesticide applicator license limited to the\nclassifications for which he is qualified which shall expire at the end of the calendar\nyear of issue unless it has been revoked or suspended prior to that by the department\nfor cause as provided for in KRS 217B.120.\n(2) No license shall be issued unless the applicant holds a valid certification within this\ncategory.\n(3) No license shall be issued unless the applicant is employed or supervised by a\nperson who holds a valid operator's license.","path":["KRS Chapter 217B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51110","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:28Z","sha256":"526b9527da993d30a1f77243476500b51f4fd2a85ed8cb6f387341ba854a396e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217b.070","next":"us-ky/krs-217b.090"},"notice":"GroundRules: Original legal text.
