{"data":{"id":"us-ky/krs-217b.105","jurisdiction":"us-ky","citation":"KRS 217B.105","heading":"Registration of pesticide dealers -- Fees -- Branch offices -- Required","body":"records.\n(1) No person shall act in the capacity of a dealer, or shall engage or offer to engage in\nthe business of, advertise as, or assume to act as a dealer without h aving registered\nas a dealer with the department.\n(2) Application for a dealer registration shall be in the form and shall contain the\ninformation prescribed by the department. Each application shall be accompanied\nby a fee of seventy -five dollars ($75). A ll registrations issued under this section\nshall expire on December 31 of the year for which they are issued. The registration\nfor a dealer may be renewed annually upon application to the department,\naccompanied by a fee of seventy -five dollars ($75) for e ach registration, on or\nbefore the first day of January of the calendar year for which the registration is\nissued.\n(3) No person shall be registered as a dealer without proof of financial responsibility as\nrequired by KRS 217B.130.\n(4) A dealer shall register each branch office location.\n(5) Application for a branch office registration shall be in the form and shall contain the\ninformation prescribed by the department. Each application shall be accompanied\nby a fee of fifty dollars ($50). All registrations issued under this section shall expire\non December 31. The registration for a branch office may be renewed annually upon\napplication to the department, accompanied by a fee of fifty dollars ($50) for each\nregistration, on or before the first of January of the calendar year for which the\nregistration is issued. No branch office registration may be issued unless the\napplicant is registered as a dealer.\n(6) The department shall issue to each applicant who satisfies the requirements of this\nsection a registration which entitles the applicant to conduct the business described\nin the application for the calendar year for which the registration is issued, unless\nthe registration is sooner revoked or suspended.\n(7) The department shall promulgate administrative regu lations requiring dealers to\nmaintain records with respect to their operations as it determines are necessary for\nthe effective enforcement of this chapter. The records shall include, but not be\nlimited to, brands and amounts of restricted use pesticides s old, and the buyer's\nname, address, use of the pesticide, and certification number. Records required\nunder this section shall extend to financial data, sales data, shipment data, and\npersonnel data. The records are to be retained for a period of two (2) ye ars from the\ntime of sale.
