{"data":{"id":"us-ky/krs-217b.120","jurisdiction":"us-ky","citation":"KRS 217B.120","heading":"Assessment of civil penalties, suspension, revocation, delay, or","body":"modification of license or registration -- Causes.\nThe department may assess civil penalties as provided by KRS 217B.193, or may\nsuspend, revoke, delay issuing, or modify the p rovision of any license or registration\nissued under this chapter, if it finds that the applicant or holder has committed any of the\nfollowing acts, each of which is declared to be a violation of this chapter:\n(1) Made a pesticide application not in accord ance with the label registered by the\ndepartment under KRS 217.541 to 217.640;\n(2) Applied known ineffective or improper materials;\n(3) Operated equipment not functioning as intended or designed by the manufacturer;\n(4) Operated equipment in a manner not intended or designed by the manufacturer;\n(5) Refused or, after notice, neglected to comply with the provisions of this chapter, the\nadministrative regulations promulgated under this chapter, or of any lawful order of\nthe department;\n(6) Refused or neglected to keep and maintain the records required by this chapter, or to\nmake reports when and as required;\n(7) Made false records, invoices, or reports;\n(8) Made false representations in an application for a license or registration or renewal\nof a license or registration;\n(9) Refused or neglected to comply with any limitations or restrictions on or in a duly\nissued license or registration;\n(10) Impersonated any state, county, or city inspector or official;\n(11) Made a sale to, or distributed a restricted use pesticide to, an unlicensed applicator;\n(12) Failed to obtain any license or registration required by this chapter;\n(13) Failed to obtain or maintain financial responsibility required by this chapter;\n(14) Failed to comply with the provisions of KRS 217B.190; or\n(15) Failed to provide direct supervision of a trainee by a licensed operator or applicator\nin the application of a pesticide.","path":["KRS Chapter 217B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51113","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:28Z","sha256":"4030275057f6586f9429d39f65f323017d6b64583093faabd45d350ea07e45d6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217b.110","next":"us-ky/krs-217b.130"},"notice":"GroundRules: Original legal text.
