{"data":{"id":"us-ky/krs-217b.130","jurisdiction":"us-ky","citation":"KRS 217B.130","heading":"Financial responsibility.","body":"(1) The department shall not issue or renew a dealer registration to a dealer applying\npesticides to the lands of others until the applicant has furnished evidence of\nfinancial responsibility with the department consisting either of a surety bond or a\nliability insurance policy, or certification of the bond or policy, protecting persons\nwho may suffer legal damages as a result of the applicant.\n(2) The amount of the surety bond or liability insurance as provided for in this section\nshall be not less than one mi llion dollars ($1,000,000). The surety bond or liability\ninsurance shall be maintained at not less than that amount at all times during the\nlicensed period. The department shall be notified ten (10) days prior to any\nreduction at the request of the applica nt or cancellation of the surety bond or\nliability insurance by the surety or insurer. The total and aggregate of the surety and\ninsurer for all claims shall be limited to the face of the bond or liability insurance\npolicy. The department may accept a liability insurance policy or surety bond in the\nproper sum which has a deductible clause in an amount not exceeding one thousand\ndollars ($1,000) for all applicators for the total amount of liability insurance or\nsurety bond required. If the applicant has not  satisfied the requirements of the\ndeductible amount in any prior legal claim, the deductible clause shall not be\naccepted by the department unless the applicant furnishes the department with a\nsecurity bond or liability insurance which shall satisfy the a mount of the deductible\nas to all claims that may arise in his application of pesticides.\n(3) Should the surety furnished become unsatisfactory, the applicant shall upon notice\nexecute a new bond or insurance and shall he fail to do so, the department shal l\ncancel the registration and it shall be unlawful for the person to engage in the\nbusiness of applying pesticides until the bond or insurance is brought into\ncompliance with the requirements of subsection (2) of this section and the\nregistration is reinstated by the department.\n(4) Nothing in this chapter shall be construed to relieve any person from liability for\nany damage to the person or lands of another caused by the use of pesticides even\nthough the use conforms to the administrative regulations of the department.","path":["KRS Chapter 217B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9539","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:28Z","sha256":"046d0953808c6b72029b9581b2aeef70601c46a5fa63bfeff18aa06858f6fed8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217b.120","next":"us-ky/krs-217b.140"},"notice":"GroundRules: Original legal text.
