{"data":{"id":"us-ky/krs-217b.180","jurisdiction":"us-ky","citation":"KRS 217B.180","heading":"Exemptions from licensing or registration.","body":"(1) The provisions of KRS 217B.020 to 217B.180 relating to licenses or registration\nand requirements for their issuance shall not apply to any farmer owner of ground\nequipment applying nonrestricted use pesticides for himself or his farmer neighbors\nif he appl ies the pesticides for his farmer neighbors without compensation other\nthan trading of personal services.\n(2) The licensing or registration provisions of KRS 217B.020 to 217B.180 and KRS\n217B.500 to 217B.585 shall not apply to any person:\n(a) Using handpow ered equipment, devices, or contrivances to apply\nnonrestricted use pesticides to lawns, or to ornamental shrubs and trees not in\nexcess of twelve (12) feet high, as an incidental part of his activity of taking\ncare of his household lawn and yard or those of his neighbors, on the\ncondition that the person shall not publicly hold himself out as being in the\nbusiness of applying pesticides, and shall not accept compensation other than\nthe trading of personal services for the activity; or\n(b) Using nonrestrict ed use pesticides to prevent, control, repel, or eliminate\nwood destroying organisms or general pests in, around, or outside his or her\nhousehold for the purpose of mitigating threats to the structural integrity, the\nhuman occupancy, or the contents of such household, on the condition that the\nperson shall not publicly represent himself or herself as being in the business\nof applying pesticides, and shall not accept compensation other than the\ntrading of personal services for the activity.\n(3) KRS 217B.020 to 217B.180 shall not apply to operators presently licensed and\nregulated under the provisions of KRS 249.250 to 249.340 on June 17, 1978, except\nthat if required by EPA regulations the persons may be issued, without additional\nfees or examination, an appl icator's license to enable them to purchase and use\nrestricted use pesticides in accordance with the requirements of the Federal\nEnvironmental Pesticide Control Act of 1972.\n(4) The registration provisions of KRS 217B.105 shall not apply to any noncommerci al\napplicator.\n(5) The licensing provisions of KRS 217B.080 shall not apply to any trainee.","path":["KRS Chapter 217B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51115","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:28Z","sha256":"e3f130f5effc8527e8a366e14125144612a302de16dc69ead80c58ea47c1c66a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217b.170","next":"us-ky/krs-217b.185"},"notice":"GroundRules: Original legal text.
