{"data":{"id":"us-ky/krs-217b.193","jurisdiction":"us-ky","citation":"KRS 217B.193","heading":"Notice of noncompliance -- Civil penalty assessment and development of","body":"schedule.\n(1) If any of the requirements of this chapter or administrative regulations promulgated\nunder this chapter have not been complied with, the department shall ca use a notice\nof violation to be issued. The department may issue an order for immediate\ncompliance and assess the civil penalty provided for in this section and in KRS\n217B.990, or the department may set forth in his notice a reasonable time period,\nbut no t more than ninety (90) days, for the abatement of the violation. If any\nlicensee or registration holder has not abated the violation within the period of time\nprescribed in the notice of violation, the department shall issue an order for\nimmediate compliance and assess the civil penalty provided for in this section and\nin KRS 217B.990. The notice of noncompliance shall be mailed to the licensee or\nregistration holder by certified mail, return receipt requested, addressed to the\npermanent address as shown o n department records. The notice of noncompliance\nshall specify in what respect the licensee or registration holder has failed to comply\nwith this chapter or administrative regulations promulgated under this chapter. If the\nlicensee or registration holder has not complied with the requirements set forth in\nthe notice of noncompliance within the time limit allowed, the license or\nregistration may be revoked as provided in this chapter.\n(2) The department shall develop a method for calculating the civil penal ty for a\nviolation, or failure to abate a violation, within the prescribed time period as\nauthorized by this section, and he shall promulgate a schedule of the civil penalties\nin an administrative regulation.","path":["KRS Chapter 217B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51118","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:28Z","sha256":"5bfe37288a986c9516029811df01433408df80bf6bb98ccf228351753b430e56","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217b.190","next":"us-ky/krs-217b.195"},"notice":"GroundRules: Original legal text.
