{"data":{"id":"us-ky/krs-217b.270","jurisdiction":"us-ky","citation":"KRS 217B.270","heading":"Prohibition against local regulation of fertilizer and pesticides --","body":"Establishment of department's authority for the regulation of pesticides sold\nand used in the Commonwealth.\n(1) The Commonwealth of Kentucky hereby determines that the citi zens of the state\nbenefit from a system of safe, effective, and scientifically sound fertilizer and\npesticide regulation. The Commonwealth further finds that a system of fertilizer and\npesticide regulation which is consistent, coordinated, and comports wit h both\nfederal and state technical expertise is essential to the public health, safety, and\nwelfare, and that local regulation of fertilizer and pesticides does not materially\nassist in achieving these benefits.\n(2) No city, town, county, or other politica l subdivision of the Commonwealth shall\nadopt or continue in effect any ordinance, resolution, rule, or regulation regarding\nfertilizer regulated pursuant to KRS 250.371 and pesticide sale or use, including\nwithout limitation: registration, notification of  use, advertising and marketing\ndistribution, training, licensing, and certification, storage, transportation, disposal,\ndisclosure of confidential information, or product composition.\n(3) Authority for the regulation of pesticides sold and used in the Com monwealth of\nKentucky is hereby established in the department.\n(4) Nothing in this section shall be construed to:\n(a) Abrogate any authority afforded by the state statutes to any program cabinet\nestablished under KRS Chapter 12 or any state or federal mand ated hazardous\nmaterials regulations or fire safety codes and comprehensive hazardous\nmaterials management program;\n(b) Abrogate the planning and zoning authority granted local government\npursuant to KRS Chapter 100; or\n(c) Waive any reporting requirement established by state or federal law or\nregulation.","path":["KRS Chapter 217B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51120","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:28Z","sha256":"094b979da5c57e42ceb5d261082a02f039e212fdc009bd7e7814abe9cb4bb9f2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217b.260","next":"us-ky/krs-217b.300"},"notice":"GroundRules: Original legal text.
