{"data":{"id":"us-ky/krs-217b.500","jurisdiction":"us-ky","citation":"KRS 217B.500","heading":"Definitions for KRS 217B.505 to 217B.585.","body":"As used in KRS 217B.500 to 217B.585 unless the context requires otherwise:\n(1) \"Applicant\" means any person applying for a license;\n(2) \"Applicator\" means a licensed person who makes pesticide applications;\n(3) \"Board\" means the Structural Pest Management Advisory Board;\n(4) \"Carpenter ants\" means those ants that damage wooden structures and are classified\nwithin the genus Camponotus;\n(5) \"Carpenter bees\" means those bees that damage wooden structures and are\nclassified in the genus Xylocopa;\n(6) \"Commercial pesticide application\" means a pesticide application made by a\nlicensed person or trainee employed by a structural pest management company on\nthe property of another for a fee;\n(7) \"Department\" means the Kentucky Department of Agriculture;\n(8) \"Direct supervision\" means the act or process whereby the application of a pesticide\nis made by a competent person acting under the instructions and control of a\ncertified operator or certified applicator who is responsible for the actions of that\nperson and who is available if and when needed, even though such certified\noperator or certified applicator is not physically present at the time and place the\npesticide is applied;\n(9) \"General pests\" means any arthropods, mollusks, annelid worms, rodents, or other\npestiferous vertebrate animals, vermin, or fungi, excluding those defined in\nsubsections (4), (5), (13), (16), and (20) of this section;\n(10) \"KPMA\" means the Kentucky Pest Management Association, Inc;\n(11) \"License\" means an instrument issued by the department t hat certifies a person is\ncompetent to make pesticide applications in a structural pest management category;\n(12) \"Noncommercial pesticide application\" means pesticide applications made by an\napplicator, in the course of employment, on property owned, occu pied, or managed\nby the applicator or his or her employer;\n(13) \"Office\" means any location where the application records or pesticide inventory of\na structural pest management company are stored;\n(14) \"Old house borer\" means the cerambycid beetle Hylotrupes bajalus (L.);\n(15) \"Operator\" means a licensed person who manages a structural pest management\ncompany and makes pesticide applications or supervises applicators or trainees\nmaking pesticide applications;\n(16) \"Powder post beetle\" means the beetles that damage wooden structures and are\nclassified within the families Lyctidae, Bostrichidae, or Anobiidae;\n(17) \"Structural fumigation\" means the use of poisonous gases for the control of general\npests and wood destroying organisms in enclosed structures;\n(18) \"Structural pest management\" means the use of pesticides to prevent, control, repel,\nor eliminate wood destroying organisms or general pests in, around, or outside\nstructures for the purpose of mitigat ing threats to structural integrity, the human\noccupancy, or the contents of such structures;\n(19) \"Structural pest management company\" means any company that provides\ncommercial structural pest management or commercial structural fumigation\nservices for a fee;\n(20) \"Termite\" means the eastern subterranean termite, Reticulotermes flavipes (Kollar),\nthe southeastern subterranean termite, R. virginicus Banks, or the light southeastern\nsubterranean termite, R. hageni Banks;\n(21) \"Trainee\" means an unlicensed p erson employed by a structural pest management\ncompany to make pesticide applications; and\n(22) \"Wood destroying organisms\" means those organisms that cause damage to the\nwood used in the construction of structures including the insects defined under\nsubsections (4), (5), (13), (16), and (20) of this section.","path":["KRS Chapter 217B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51121","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:28Z","sha256":"f84a33b65ec1a3ea30366b83d6613c5c39c5d21dbe727749c162aa62a304478d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217b.320","next":"us-ky/krs-217b.505"},"notice":"GroundRules: Original legal text.
