{"data":{"id":"us-ky/krs-217b.990","jurisdiction":"us-ky","citation":"KRS 217B.990","heading":"Penalties for chapter.","body":"(1) Any person who violates any of the provisions of this chapter or who fails to\nperform any duties imposed by those sections, or who violates any determination or\norder of the department promulgated pursuant thereto shall be liable to a civil\npenalty of not to exceed the sum of one thousand dollars ($1,000) for that violation,\nand an additional civil penalty of not to exceed one thousand dollars ($1,000) for\neach day during which the violation continues, and in addition, may be enjoined\nfrom continuing the vi olations as provided in this section. The penalties shall be\nrecoverable in an action brought in the name of the Commonwealth of Kentucky by\nthe department, or upon the department's request by the Attorney General.\n(2) Any person who fails to abate a viola tion within the time period prescribed by\nadministrative regulation for the abatement shall be assessed a civil penalty of not\nless than one hundred dollars ($100). Each day of continuing violation may be\ndeemed a separate violation for the purpose of pena lty assessment. The\nCommissioner shall develop a method for calculating monetary penalties and shall\npromulgate a schedule of the penalties in an administrative regulation. The penalty\nshall be recoverable in an action brought in the name of the Commonweal th. All\nsums of recovery shall be placed in the State Treasury. A license holder shall have\nthirty (30) days from notification of the penalty assessment to request a hearing.\n(3) Any person who shall willfully violate any of the provisions of this chapter or any\ndetermination or order of the department promulgated pursuant to those sections\nwhich have become final shall be guilty of a misdemeanor and upon conviction\nthereof shall be punished by a fine of not less than one hundred dollars ($100) nor\nmore than one thousand dollars ($1,000) or by imprisonment for a term of not more\nthan one (1) year, or by both fine and imprisonment for each separate violation.\nEach day upon which such violation occurs shall constitute a separate violation.","path":["KRS Chapter 217B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51138","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:29Z","sha256":"dea7275936b2cac4d933287408b6671671972604097eeba89b2e07dde940693d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217b.585","next":"us-ky/krs-217c.010"},"notice":"GroundRules: Original legal text.
