{"data":{"id":"us-ky/krs-218a.025","jurisdiction":"us-ky","citation":"KRS 218A.025","heading":"Controlled Substances Prescribing Council -- Membership -- Duties --","body":"Report.\n(1) The Controlled Substances Prescribing Council is hereby established under the\nOffice of the Inspector General. The council shall consist of the following fiftee n\n(15) members:\n(a) The Inspector General of the Cabinet for Health and Family Services, who\nshall serve as chair of the council;\n(b) The executive director of the Office of Drug Control Policy;\n(c) Two (2) currently licensed prescribers of scheduled drugs  selected by the\nKentucky Board of Dentistry, one (1) of whom shall be a dentist and one (1)\nof whom shall be an oral surgeon;\n(d) Three (3) licensed physicians who currently prescribe scheduled drugs\nselected by the Kentucky Board of Medical Licensure, on e (1) of whom shall\nhave a specialty in primary care, one (1) of whom shall have a specialty in\npsychiatry or addiction medicine, and one (1) of whom shall have a specialty\nin pain management;\n(e) Three (3) licensed advanced practice registered nurses who currently\nprescribe scheduled drugs selected by the Kentucky Board of Nursing, one (1)\nof whom shall have a specialty in primary care, one (1) of whom shall have a\nspecialty in psychiatric mental health or addiction, and one (1) of whom shall\nhave a specialty in pain management;\n(f) One (1) licensed prescriber of scheduled drugs selected by the Kentucky\nBoard of Optometric Examiners;\n(g) One (1) licensed prescriber of scheduled drugs selected by the Kentucky\nBoard of Podiatry;\n(h) One (1) licensed pharmacis t selected by the Kentucky Board of Pharmacy;\nand\n(i) Two (2) licensed veterinarians who currently prescribe and dispense\nscheduled drugs selected by the Kentucky Board of Veterinary Examiners,\none (1) of whom shall have a specialty in livestock as defined  in KRS\n257.010, and one (1) of whom shall have a specialty in equine medicine.\n(2) The council shall meet at least quarterly to discuss matters relating to the safe and\nappropriate prescribing and dispensing of controlled substances, including:\n(a) The review of quarterly reports issued by the Office of the Inspector General\npursuant to KRS 218A.202(9) to identify potential improper, inappropriate, or\nillegal prescribing or dispensing of controlled substances by examining\naggregate patterns of prescribing by profession of the prescriber and county\nwhere the medication was prescribed and dispensed;\n(b) Recommendations for improvements in data collection and reporting by the\nelectronic system for monitoring controlled substances pursuant to KRS\n218A.202;\n(c) Recommendations for best prescribing practices based on up-to-date research;\n(d) Recommendations to the professional licensing boards for actions to aid in\nenforcing current law, reviewing prescribing and dispensing data, and\ncorrecting improper, inappropriate, or illegal prescribing or dispensing of a\ncontrolled substance; and\n(e) Development and communication of any recommendations, based on review\nof data or research, to each licensure board. The licensure boards shall\nrespond in writing to the panel within ninety (90) days of receiving the\nrecommendations with an explanation of their r esponse to the\nrecommendations.\n(3) The council may request information from the licensure boards regarding their\nprocedures for conducting investigations and taking actions regarding the possible\nimproper, inappropriate, or illegal prescribing or dispensi ng of controlled\nsubstances.\n(4) On or before December 31 of each year, the council shall submit an annual report to\nthe Governor and the Legislative Research Commission for referral to the Interim\nJoint Committee on Health Services. The annual report shall:\n(a) List the council's meeting dates and topics for the preceding year;\n(b) Provide relevant statistical information, including a summary of the aggregate\npatterns by profession of prescriber and by county, of potential improper,\ninappropriate, or illegal prescribing or dispensing of a controlled substance;\n(c) Describe the efforts made by the council to share information among the\nlicensure boards related to improving the safe and appropriate prescribing and\ndispensing of controlled substances;\n(d) Summarize responses received from the licensure boards to the panel's\nrecommendations; and\n(e) Provide any policy recommendations, including recommendations for\nstatutory or administrative regulation changes intended to improve prescribing\nand dispensing pract ices and prevent improper, inappropriate, or illegal\nprescribing or dispensing of controlled substances.\n(5) The council shall not make any recommendations related to the scope of practice of\nany prescribing or dispensing professionals.\n(6) The council sha ll be attached to the Office of the Inspector General for\nadministrative purposes.\n(7) Members shall not receive any additional compensation for their service on the\ncouncil but shall be reimbursed for all necessary expenses.","path":["KRS Chapter 218A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56987","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:29Z","sha256":"64b83346606c03e53f31abe73d7f6443e14f4bcb8e86ab27291bdc841c03b57f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-218a.020","next":"us-ky/krs-218a.030"},"notice":"GroundRules: Original legal text.
