{"data":{"id":"us-ky/krs-218a.135","jurisdiction":"us-ky","citation":"KRS 218A.135","heading":"Pretrial release of defendant charged with offense for which conviction","body":"may result in presumptive probation.\n(1) Any statute to the contrary notwithstanding, a defendant charged with an offense\nunder this chapter for which a conviction may result i n presumptive probation shall\nbe placed on pretrial release on his or her own recognizance or on unsecured bond\nby the court subject to any conditions, other than bail, specified in KRS 431.515 to\n431.550.\n(2) The provisions of this section shall not apply  to a defendant who is found by the\ncourt to present a flight risk or to be a danger to others.\n(3) If a court determines that a defendant shall not be released pursuant to subsection\n(2) of this section, the court shall document the reasons for denying th e release in a\nwritten order.","path":["KRS Chapter 218A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40909","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:29Z","sha256":"804e5a351db6943b063f3f6a5e5c996e8a8913da462181870d9394fdc0b58333","source_id":"us-ky","stale":false,"prev":"us-ky/krs-218a.133","next":"us-ky/krs-218a.136"},"notice":"GroundRules: Original legal text.
