{"data":{"id":"us-ky/krs-218a.140","jurisdiction":"us-ky","citation":"KRS 218A.140","heading":"Prohibited acts relating to controlled substances -- Penalties.","body":"(1) (a) No person shall obtain or attempt to obtain a prescription for a controlled\nsubstance by knowingly misrepresenting to, or knowingly withholding\ninformation from, a practitioner.\n(b) No person shall procure or attempt to procure the administration of a\ncontrolled substance by knowingly misrepresenting to, or withholding\ninformation from, a practitioner.\n(c) No person shall obtain or attempt to obtain a controlled substance or procure\nor attempt to procure the administration of a controlled substance by the u se\nof a false name or the giving of a false address.\n(d) No person shall knowingly make a false statement regarding any prescription,\norder, report, or record required by this chapter.\n(e) No person shall, for the purpose of obtaining a controlled substanc e, falsely\nassume the title of or represent himself or herself to be a manufacturer,\nwholesaler, distributor, repacker, pharmacist, practitioner, or other authorized\nperson.\n(f) In order to obtain a controlled substance, no person shall present a\nprescription for a controlled substance that was obtained in violation of this\nchapter.\n(g) No person shall affix any false or forged label to a package or receptacle\ncontaining any controlled substance.\n(2) No person shall possess, manufacture, sell, dispense, pre scribe, distribute, or\nadminister any counterfeit substance.\n(3) No person shall knowingly obtain or attempt to obtain a prescription for a\ncontrolled substance without having formed a valid practitioner -patient relationship\nwith the practitioner or his or  her designee from whom the person seeks to obtain\nthe prescription.\n(4) No person shall knowingly assist a person in obtaining or attempting to obtain a\nprescription in violation of this chapter.\n(5) Any person who violates any subsection of this section shall be guilty of a Class D\nfelony.","path":["KRS Chapter 218A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39528","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:29Z","sha256":"29d9d52253bfbf61f0b5c7257fa808dc5e6fd8580599ebd1f4e00070831fc718","source_id":"us-ky","stale":false,"prev":"us-ky/krs-218a.136","next":"us-ky/krs-218a.1401"},"notice":"GroundRules: Original legal text.
