{"data":{"id":"us-ky/krs-218a.1412","jurisdiction":"us-ky","citation":"KRS 218A.1412","heading":"Trafficking in controlled substance in first degree -- Penalties.","body":"(1) A person is guilty of trafficking in a controlled substance in the first degree when\nhe or she knowingly and unlawfully traffics in:\n(a) Four (4) grams or more of cocaine;\n(b) Two (2) grams or more of methamphetamine;\n(c) Ten (10) or more dosage units of a controlled substance that is classified in\nSchedules I or II and is a narcotic drug, or a controlled substance analogue;\n(d) Any quantity of heroin, fentanyl, carfenta nil, or fentanyl derivatives; lysergic\nacid diethylamide; phencyclidine; gamma hydroxybutyric acid (GHB),\nincluding its salts, isomers, salts of isomers, and analogues; or flunitrazepam,\nincluding its salts, isomers, and salts of isomers; or\n(e) Any quantity of a controlled substance specified in paragraph (a), (b), or (c) of\nthis subsection in an amount less than the amounts specified in those\nparagraphs.\n(2) The amounts specified in subsection (1) of this section may occur in a single\ntransaction or may o ccur in a series of transactions over a period of time not to\nexceed ninety (90) days that cumulatively result in the quantities specified in this\nsection.\n(3) (a) Any person who violates the provisions of subsection (1)(a), (b), (c), or (d) of\nthis section shall be guilty of a Class C felony for the first offense and a Class\nB felony for a second or subsequent offense.\n(b) Any person who violates the provisions of subsection (1)(e) of this section\nshall be guilty of a Class D felony for the first offense and a Class C felony\nfor a second or subsequent offense.\n(c) If the substance is fentanyl or a fentanyl derivative, and th e injection,\ningestion, inhalation, or other introduction of the fentanyl or fentanyl\nderivative causes the death of a person, the penalty for the offense shall be\none (1) level higher than the level otherwise specified in this section.\n(d) Any person convicted of a Class C felony offense or higher under this section\nshall not be released on probation, shock probation, parole, conditional\ndischarge, or other form of early release until he or she has served at least fifty\npercent (50%) of the sentence imposed in cases where the trafficked substance\nwas heroin, fentanyl, carfentanil, or fentanyl derivatives.","path":["KRS Chapter 218A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55442","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:29Z","sha256":"01ed908fb2b453a9c67ece94469640e4e9a80b1dc103b21088041d390251ece5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-218a.1411","next":"us-ky/krs-218a.1413"},"notice":"GroundRules: Original legal text.
