{"data":{"id":"us-ky/krs-218a.1423","jurisdiction":"us-ky","citation":"KRS 218A.1423","heading":"Marijuana cultivation -- Penalties.","body":"(1) A person is guilty of marijuana cultivation when he or she knowingly and\nunlawfully plants, cultivates, or harvests marijuana with the intent to sell or transfer\nit, and the cultivation is not in compliance with, or otherwise authorized by, KRS\nChapter 218B.\n(2) Unless authorized by KRS Chapter 218B, marijuana cultivation of five (5) or more\nplants of marijuana is:\n(a) For a first offense a Class D felony.\n(b) For a second or subsequent offense a Class C felony.\n(3) Unless authorized by KRS Chapter 218B, ma rijuana cultivation of fewer than five\n(5) plants is:\n(a) For a first offense a Class A misdemeanor.\n(b) For a second or subsequent offense a Class D felony.\n(4) Unless authorized by KRS Chapter 218B, the planting, cultivating, or harvesting of\nfive (5) or  more marijuana plants shall be prima facie evidence that the marijuana\nplants were planted, cultivated, or harvested for the purpose of sale or transfer.\n(5) This section does not apply to a cannabis business or a cannabis business agent, as\ndefined in KRS 218B.010, when acting in compliance with KRS Chapter 218B.","path":["KRS Chapter 218A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54300","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:30Z","sha256":"cd3b7485a72a418e2f6bff0689349a50f235d8ee4b32eb712a743307c668d3f3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-218a.1422","next":"us-ky/krs-218a.1426"},"notice":"GroundRules: Original legal text.
