{"data":{"id":"us-ky/krs-218a.1439","jurisdiction":"us-ky","citation":"KRS 218A.1439","heading":"Trafficking in or transferring a dietary supplement -- Exceptions --","body":"Penalties.\n(1) A person is guilty of trafficking in or transferring a dietary supplement when he or\nshe traffics in or transfers any dietary supplement product containing ephedrine\ngroup alkaloids, except as provided in this section.\n(2) The prohibition in subsection (1) of this section shall not apply to:\n(a) A practitioner or pharmacist licensed in this Commonwealth who is practicing\nwithin his or her scope of practice and who pre scribes or dispenses, or both,\ndietary supplement products containing ephedrine alkaloids in the course of\nthe treatment of a patient under the direct care of the prescribing practitioner,\nexcept that a licensed practitioner or registered pharmacist shall not prescribe\nor dispense dietary supplement products containing ephedrine group alkaloids\nfor purposes of weight loss, body building, or athletic performance\nenhancement;\n(b) Dietary supplement products containing ephedrine group alkaloids that are\nsold or distributed directly to a licensed practitioner or registered pharmacist,\nwhen the dietary supplement products containing ephedrine group alkaloids\nare used solely for the purpose of the treatment of patients under the direct\ncare of the practitioner;\n(c) Dietary supplement products containing ephedrine group alkaloids that are\nsold or distributed directly to a licensed practitioner or registered pharmacist\nfor resale to a patient for whom the products have been prescribed under\nparagraph (a) of this subsection; or\n(d) Dietary supplement products containing ephedrine group alkaloids that are not\nfor resale in this Commonwealth and that are sold or distributed directly to\nbusinesses not located in this Commonwealth.\n(3) Trafficking in or transferring a dietary supplement is:\n(a) For the first offense, a Class A misdemeanor; and\n(b) For a second or subsequent offense, a Class D felony.","path":["KRS Chapter 218A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9661","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:30Z","sha256":"7713fdfb05e46480fd9c5566808f3962d5c699fbf70cf0e0a8fe9cc7a8684b3d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-218a.1438","next":"us-ky/krs-218a.1440"},"notice":"GroundRules: Original legal text.
