{"data":{"id":"us-ky/krs-218a.1447","jurisdiction":"us-ky","citation":"KRS 218A.1447","heading":"Restrictions on possession of dextromethorphan and sale of products","body":"containing dextromethorphan.\n(1) A person, other than a medical facility, medical practitioner, pharmacist, pharmacy\nintern, pharmacy technician, pharmacy licensed or registered under KR S Chapter\n315, or registrant under the Federal Food, Drug, and Cosmetic Act, 21 U.S.C. secs.\n301 et seq., shall not possess one (1) gram or more of:\n(a) Pure dextromethorphan; or\n(b) Dextromethorphan extracted from solid or liquid dose forms, as defined by\nUnited States Pharmacopeia reference standards.\n(2) A person shall not sell any products containing dextromethorphan to individuals\nunder eighteen (18) years of age, except that in any prosecution for selling a product\ncontaining dextromethorphan to an in dividual under eighteen (18) years of age it\nshall be an affirmative defense that the sale was induced by the use of false,\nfraudulent, or altered identification papers or other documents and that the\nappearance and character of the purchaser were such tha t his or her age could not\nhave been ascertained by any other means and that the purchaser's appearance and\ncharacter indicated strongly that he or she was of legal age to purchase products\ncontaining dextromethorphan. This evidence may be introduced eithe r in mitigation\nof the charge or as a defense to the charge itself.\n(3) Any person who sells any product containing dextromethorphan shall limit access to\nthese products by requiring proof of age from a prospective buyer by showing a\ngovernment-issued photo identification card that displays his or her date of birth if\nthe person has reason to believe that the prospective buyer is under the age of\neighteen (18) years.","path":["KRS Chapter 218A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44260","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:30Z","sha256":"eb8e1fffc2a932bbcee7368f4b474d614b9e71c1ebe01a50543e510ab808f3cb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-218a.1446","next":"us-ky/krs-218a.1448"},"notice":"GroundRules: Original legal text.
