{"data":{"id":"us-ky/krs-218a.182","jurisdiction":"us-ky","citation":"KRS 218A.182","heading":"Electronic prescribing of controlled substances required -- Exceptions --","body":"Duties of pharmacist -- Administrative regulations.\n(1) Notwithstanding KRS 218A.180 or any other state law to the contrary, beginning\nJanuary 1, 2021, no practiti oner shall issue any prescription for a controlled\nsubstance unless the prescription is made by electronic prescription from the\npractitioner issuing the prescription to a pharmacy, except for prescriptions issued:\n(a) By veterinarians;\n(b) In circumstance s where electronic prescribing is not available due to\ntemporary technological or electrical failure;\n(c) By a practitioner to be dispensed by a pharmacy located outside the state;\n(d) When the prescriber and dispenser are the same entity;\n(e) That include  elements that are not supported by the most recently\nimplemented version of the National Council for Prescription Drug Programs\nPrescriber/Pharmacist Interface SCRIPT Standard;\n(f) By a practitioner for a drug that contains certain elements that cannot be\nincorporated as required by the United States Food and Drug Administration\nwith electronic prescribing, including extemporaneous compounding;\n(g) By a practitioner allowing for the dispensing of a nonpatient specific\nprescription under a standing order, a pproved protocol for drug therapy, or\ncollaborative drug management or comprehensive medication management, in\nresponse to a public health emergency;\n(h) By a practitioner prescribing a drug under a research protocol;\n(i) By practitioners who have received  a waiver or a renewal thereof, from the\nrequirement to use electronic prescribing due to economic hardship,\ntechnological limitations that are not reasonably within the control of the\npractitioner, or other exceptional circumstance demonstrated by the\npractitioner. The initial waiver and each subsequent waiver renewal shall not\nexceed one (1) year per waiver or waiver renewal;\n(j) By a practitioner under circumstances where, notwithstanding the\npractitioner's present ability to make an electronic prescription as required by\nthis subsection, the practitioner reasonably determines that it would be\nimpractical for the patient to obtain  substances prescribed by electronic\nprescription in a timely manner, and delay would adversely impact the\npatient's medical condition;\n(k) By a practitioner for an individual who receives hospice care;\n(l) By a practitioner for an individual who is a resident of a nursing facility; or\n(m) By a practitioner who is issuing a prescription as part of providing charitable\nhealth care services pursuant to the Kentucky Charitable Health Care Services\nAct, KRS 216.940 to 216.945.\n(2) A pharmacist who receives a wr itten, oral, or faxed prescription for a controlled\nsubstance shall not be required to verify that the prescription properly falls under\none (1) of the exceptions from the requirement to electronically prescribe.\nPharmacists may continue to dispense medica tions from otherwise valid written,\noral, or fax prescriptions that are consistent with current laws and administrative\nregulations.\n(3) The cabinet shall promulgate administrative regulations to implement this section\nincluding enforcement mechanisms, wai vers of requirements, and appropriate\npenalties for violations.","path":["KRS Chapter 218A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57303","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:30Z","sha256":"a9dbff60738d2035c3d4fc7e046f38be62ae735d228bb6705b148731d790ae3a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-218a.180","next":"us-ky/krs-218a.185"},"notice":"GroundRules: Original legal text.
