{"data":{"id":"us-ky/krs-218a.190","jurisdiction":"us-ky","citation":"KRS 218A.190","heading":"Exempt codeine preparations.","body":"(1) Nonprescription medicinal preparations that contain in one hundred (100)\nmilliliters, or as a solid or semisolid preparation, in one hundred (100) grams, not\nmore than two hundred (200) milligrams of codeine or its salts may be sold over the\ncounter subject to the following conditions:\n(a) That the medicinal preparation shall contain in addition to the codeine in it,\nsome drug or drugs conferring upon it medicinal qualities other than those\npossessed by the codeine alone;\n(b) That such preparation shall be dispensed or sold in good faith as a medicine,\nand not for the purpose of evading the provisions of this chapter;\n(c) That such preparation shall only be sold at retail without a prescription to a\nperson at least eighteen (18) years of age and only by a ph armacist. An\nemployee may complete the actual cash or credit transaction or delivery;\n(d) That such preparations shall not be displayed in areas of the pharmacy open to\nthe public; and\n(e) That no person shall purchase and no pharmacist or practitioner sha ll sell to\nthe same person within a forty -eight (48) hour period more than one hundred\ntwenty (120) milliliters of an exempt codeine preparation. Any person\npurchasing in excess of this limitation shall be deemed to be in illegal\npossession.\n(2) All wholesalers, manufacturers, and repackers shall keep a separate exempt codeine\nregistry showing the following:\n(a) Date;\n(b) Registration number of recipient;\n(c) Name of recipient;\n(d) Address;\n(e) Name of preparation; and\n(f) Quantity.\n(3) All pharmacists and practitioners shall keep a separate exempt codeine registry\nshowing the following:\n(a) Date;\n(b) Name of recipient;\n(c) Address;\n(d) Name of preparation;\n(e) Quantity; and\n(f) Pharmacist's or practitioner's name.\n(4) Notwithstanding any other provision of this section, the Cabinet for Health and\nFamily Services may by regulation specifically prohibit any such codeine\npreparation from being sold over the counter due to actual or potential abuse.","path":["KRS Chapter 218A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9675","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:30Z","sha256":"15591d9bbf876852732c619e99d23aeba5482a8eab78726324fd44bd6f6c8238","source_id":"us-ky","stale":false,"prev":"us-ky/krs-218a.185","next":"us-ky/krs-218a.200"},"notice":"GroundRules: Original legal text.
