{"data":{"id":"us-ky/krs-218a.230","jurisdiction":"us-ky","citation":"KRS 218A.230","heading":"Controlled substances -- Possession, forfeiture, disposition -- Records,","body":"inspection.\nAll controlled substances, the lawful possession of which is not established or the title to\nwhich cannot be ascertained, which have come into the custody of a peace  officer, shall\nbe forfeited and disposed of as follows:\n(1) Except as otherwise provided in this section, the court having jurisdiction shall\norder such controlled substances forfeited and destroyed. A record of the place\nwhere said drugs were seized, of the kinds and quantities of drugs so destroyed, and\nof the time, place, and manner of destruction, shall be kept.\n(2) The court by whom the forfeiture of controlled substances has been decreed may\norder the delivery of same to the Cabinet for Health and Fa mily Services for\ndestruction. Practitioners, pharmacists, hospitals, and nursing homes may\nvoluntarily surrender controlled substances to the Cabinet for Health and Family\nServices for destruction.\n(3) The Cabinet for Health and Family Services shall keep  a record of all substances\nreceived and of all substances disposed of, showing the exact kinds, quantities, and\nforms of such substances, the persons from whom received and the time, place, and\nmanner of destruction.\n(4) Prescriptions, orders, and records, required by this chapter, and stocks of controlled\nsubstances, shall be open for inspection only to federal, state, county, and municipal\nofficers, whose duty it is to enforce the laws of this state or of the United States\nrelating to controlled substances.\n(5) No pharmacist, practitioner, manufacturer, or wholesaler or other custodian of\nrecords, prescriptions, or orders required by this chapter shall refuse to permit the\ninspection thereof by any federal, state, county or municipal officer whose duty it  is\nto enforce the laws of this state or of the United States relating to controlled\nsubstances.","path":["KRS Chapter 218A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9681","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:30Z","sha256":"c9fb8594117f1b52bd068f24d0c8ffbcaf06a3d86e5df10d93bb7603a3561773","source_id":"us-ky","stale":false,"prev":"us-ky/krs-218a.220","next":"us-ky/krs-218a.240"},"notice":"GroundRules: Original legal text.
