{"data":{"id":"us-ky/krs-218a.245","jurisdiction":"us-ky","citation":"KRS 218A.245","heading":"Reciprocal agreements or contracts with other states, jurisdictions,","body":"counties, or political subdivisions or with an administering organization to\nshare prescription drug monitoring information.\n(1) The secretary of the Cabinet for Health  and Family Services may enter into\nreciprocal agreements or a contract, either directly with any federal agency of the\nUnited States or its territories, any other state or states of the United States or any\njurisdiction, county, or political subdivision t hereof, or with an organization\nadministering the exchange of interstate data on behalf of the prescription\nmonitoring program of one (1) or more states or jurisdictions, to share prescription\ndrug monitoring information if the other prescription drug moni toring program or\ndata exchange program is compatible with the program in Kentucky. If the\nsecretary elects to evaluate the prescription drug monitoring program of another\nstate, jurisdiction, or organization as authorized by this section, priority shall b e\ngiven to a state or jurisdiction that is contiguous with the borders of the\nCommonwealth or an organization that offers connectivity with a contiguous state\nor jurisdiction.\n(2) In determining compatibility, the secretary shall consider:\n(a) The essentia l purposes of the program and the success of the program in\nfulfilling those purposes;\n(b) The safeguards for privacy of patient records and its success in protecting\npatient privacy;\n(c) The persons authorized to view the data collected by the program;\n(d) The schedules of controlled substances monitored;\n(e) The data required to be submitted on each prescription or dispensing;\n(f) Any implementation criteria deemed essential for a thorough comparison; and\n(g) The costs and benefits to the Commonwealth in mutually sharing particular\ninformation available in the Commonwealth's database with the program\nunder consideration.\n(3) The secretary shall review any agreement on an annual basis to determine its\ncontinued compatibility with the Kentucky prescription drug monitoring program.\n(4) Any agreement between the cabinet and another state, jurisdiction, or organization\nshall prohibit the sharing of information about a Kentucky resident, practitioner,\npharmacist, or other prescriber or dispenser for any purpose not otherwise\nauthorized by this section or KRS 218A.202.","path":["KRS Chapter 218A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57305","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:30Z","sha256":"81649cb4164c5504fffeb1fa910454adf2fe305dd80b557134b3618ae4e3f9c2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-218a.240","next":"us-ky/krs-218a.250"},"notice":"GroundRules: Original legal text.
