{"data":{"id":"us-ky/krs-218a.286","jurisdiction":"us-ky","citation":"KRS 218A.286","heading":"Theft, criminal possession, trafficking, or unlawful possession of a","body":"prescription or blank.\n(1) A person is guilty of theft of a prescription blank when he unlawfully takes or\nexercises control over a prescription blank belonging to another.\n(2) A pe rson is guilty of criminal possession of a prescription blank when, with\nknowledge that he has no lawful authority to possess a prescription blank, he\npossesses a prescription blank with the intent to utter a forged prescription or sell or\ntransfer the prescription blank to another person for that purpose.\n(3) A person is guilty of trafficking in prescription blanks when he knowingly and\nunlawfully traffics in a prescription blank or a forged prescription for a controlled\nsubstance.\n(4) The knowing, with in tent to violate this chapter, possession of a prescription blank\nby a person other than a pharmacist, practitioner, or other person authorized by law\nto prescribe or dispense a controlled substance, a manufacturer, wholesaler, or\ndistributor, or by a person lawfully printing or reproducing prescription blanks, shall\nbe prima facie evidence that the prescription blank was possessed for the purpose of\nuttering a forged prescription or for sale or transfer to another person for that\npurpose.\n(5) Any person who violates any subsection of this section shall be guilty of a Class D\nfelony for the first offense and a Class C felony for a second or subsequent offense.","path":["KRS Chapter 218A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9693","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:30Z","sha256":"f4ba05b21b1320f2c440afa705190986f37f33a2084c725dbcce753a823745fb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-218a.284","next":"us-ky/krs-218a.288"},"notice":"GroundRules: Original legal text.
