{"data":{"id":"us-ky/krs-218b.030","jurisdiction":"us-ky","citation":"KRS 218B.030","heading":"Seizure and forfeiture -- Probable cause -- Rebuttable presumption of","body":"lawful use.\n(1) (a) Any medicinal cannabis, medicinal cannabis accessories, lawful property, or\ninterest in lawful property that is possessed, owned, or used in conn ection\nwith the use of medicinal cannabis or acts incidental to that use shall not be\nsubject to seizure or forfeiture under KRS 218A.405 to 218A.460.\n(b) This chapter shall not prevent the seizure or forfeiture of marijuana exceeding\nthe amounts allowed u nder KRS 218B.025 or administrative regulations\npromulgated pursuant to KRS 218B.140(1)(c)6., nor shall it prevent seizure or\nforfeiture if the basis for that action is unrelated to the use of medicinal\ncannabis in accordance with this chapter and any admi nistrative regulation\npromulgated thereunder.\n(2) Possession of, or application for, a registry identification card, an out -of-state\nregistry identification card, or cannabis business license shall not constitute\nprobable cause or reasonable suspicion, nor  shall it be used to support the search of\nthe person, property, or home of the person possessing or applying for the registry\nidentification card, out -of-state registry identification card, or cannabis business\nlicense. The possession of, or application f or, a registry identification card, out -of-\nstate registry identification card, or cannabis business license shall not preclude the\nexistence of probable cause if probable cause exists on other grounds.\n(3) (a) There shall be a rebuttable presumption that a  cardholder is engaged in the\nlawful use of medicinal cannabis, or in the case of a designated caregiver,\nassisting with the lawful use of medicinal cannabis, if the cardholder:\n1. Possesses a valid registry identification card or, in the case of a visitin g\nqualified patient, an out -of-state registry identification card and\ndocumentation of having been diagnosed with a qualifying medical\ncondition; and\n2. Possesses an amount of medicinal cannabis that does not exceed the\namount allowed under KRS 218B.025 or  administrative regulations\npromulgated pursuant to KRS 218B.140(1)(c)6.\n(b) This presumption may be rebutted by a preponderance of evidence that\nconduct was unrelated to the use of medicinal cannabis or was otherwise in\nviolation of this chapter.","path":["KRS Chapter 218B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54280","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:31Z","sha256":"c2c61a84353ffc687696dd6496f7c28a4e88c84aecd3bedf267772a0d87c285c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-218b.025","next":"us-ky/krs-218b.035"},"notice":"GroundRules: Original legal text.
