{"data":{"id":"us-ky/krs-218b.055","jurisdiction":"us-ky","citation":"KRS 218B.055","heading":"Registry identification card required -- Written certification -- Visiting","body":"qualified patient -- Information required.\n(1) Except as provided in subsection (5) of this section, no person shall possess,\npurchase, acquire, or otherwise engage or assist in the use of medicinal cannabis in\nKentucky without first applying for and receiving a registry identification card\nissued by the cabinet.\n(2) A person shall be eligible to apply for a registry identification card as a registered\nqualified patient if he or she is a resident of Kentucky, has obtained a written\ncertification from a medicinal practitioner with whom he or she has a bona fide\npractitioner-patient relationship, and has not been convicted of a disqualifying\nfelony offense.\n(3) (a) Except as provided in paragraph (b) of this subsection, a person shall be\neligible to apply for a registry identification card as a designated caregiver if\nhe or she is a resident of Kentucky, is at least twenty -one (21) years of age,\nhas not been co nvicted of a disqualifying felony offense, and has agreed to\nassist no more than three (3) registered qualified patients with the use of\nmedicinal cannabis.\n(b) Any person who has been appointed as a guardian, limited guardian,\nconservator, or limited cons ervator under KRS Chapter 387 shall be eligible\nto be designated as a designated caregiver by the individual for whom they\nhave been appointed as a guardian, limited guardian, conservator, or limited\nconservator.\n(4) A person shall be eligible to apply for  a registry identification card as a visiting\nqualified patient if he or she is not a resident of Kentucky or has been a resident of\nKentucky for less than thirty (30) days, is at least twenty -one (21) years of age, has\nnot been convicted of a disqualifyin g felony offense, possesses a valid out -of-state\nregistry identification card, and possesses documentation of having been diagnosed\nwith a qualifying medical condition.\n(5) A person with a valid out -of-state registry identification card and documentation o f\nhaving been diagnosed with a qualifying medical condition may use his or her out -\nof-state registry identification card for all purposes established in this chapter and\nshall not be required to apply for or receive a visiting qualified patient registry\nidentification card from the cabinet.\n(6) To apply for or renew a registry identification card, a qualified patient shall submit\nthe following, in accordance with administrative regulations promulgated by the\ncabinet:\n(a) The name, address, and date of birth  of the qualified patient, except that if the\napplicant is homeless an address where the applicant may be reached shall be\nprovided to the cabinet;\n(b) A written certification issued by a medicinal cannabis practitioner within sixty\n(60) days immediately preceding the date of an application;\n(c) The name, address, and telephone number of the qualified patient's medicinal\ncannabis practitioner;\n(d) The nam e, address, and date of birth of not more than two (2) individuals\nchosen by the qualified patient to be designated as a caregiver, if the qualified\npatient chooses to designate a caregiver, except that if an individual has been\nappointed as a guardian, li mited guardian, conservator, or limited conservator\nunder KRS Chapter 387, the qualified patient shall choose that individual as a\ndesignated caregiver;\n(e) A statement, signed by the qualified patient, pledging not to divert medicinal\ncannabis to anyone w ho is not permitted to possess medicinal cannabis\npursuant to this chapter. The statement shall contain a listing of potential\npenalties, including criminal prosecution, for diverting medicinal cannabis;\n(f) A statement, signed by the individuals chosen by  the qualified patient to be\ndesignated as a caregiver, if any, agreeing to be designated as the patient's\ndesignated caregiver and pledging not to divert medicinal cannabis to anyone\nother than the registered qualified patient to whom the caregiver is con nected\nthrough the cabinet's registration process. The statement shall contain a listing\nof potential penalties, including criminal prosecution, for diverting medicinal\ncannabis; and\n(g) The application or renewal fee for a registry identification card for  a qualified\npatient and the application or renewal fee for a registry identification card for\nany designated caregiver chosen by the qualified patient.\n(7) To apply for or renew a registry identification card, a qualified patient who is under\neighteen (18 ) years of age shall, in addition to the information required under\nsubsection (6) of this section, submit:\n(a) Documentation of diagnosis of a qualifying medical condition by a\npractitioner other than the medicinal cannabis practitioner who provided the\nwritten certification for the use of medicinal cannabis; and\n(b) A statement signed by the custodial parent or legal guardian with\nresponsibility for health care decisions for the qualified patient attesting to the\nfact that the custodial parent or legal guardian agrees to:\n1. Allow the qualified patient to use medicinal cannabis;\n2. Serve as the qualified patient's designated caregiver; and\n3. Control the acquisition, dosage, and frequency of use of medicinal\ncannabis by the qualified patient.\n(8) To apply for or renew a registry identification card, a visiting qualified patient shall\nsubmit the following, in accordance with administrative regulations promulgated by\nthe cabinet:\n(a) The name, address, and date of birth of the visiting qualified patient, exce pt\nthat if the applicant is homeless an address where the applicant may be\nreached shall be provided to the cabinet;\n(b) A copy of his or her valid out-of-state registry identification card;\n(c) Proof that he or she has been diagnosed with a qualifying medical condition;\n(d) The application or renewal fee for a registry identification card for a visiting\nqualified patient; and\n(e) A statement, signed by the visiting qualified patient, pledging not to divert\nmedicinal cannabis to anyone who is not permitted to possess medicinal\ncannabis pursuant to this chapter. The statement shall contain a listing of\npotential penalties, including criminal prosecution, for diverting medicinal\ncannabis.\n(9) The application for qualified patients' registry identification card s shall ask whether\nthe patient would like the cabinet to notify him or her of any clinical studies\nneeding human subjects for research on the use of medicinal cannabis. The cabinet\nshall notify interested patients if it is aware of studies that will be co nducted in the\nUnited States.\n(10) A registered qualified patient applying to renew a registry identification card issued\nby the cabinet shall be required to submit to the cabinet a written certification\nissued by a medicinal cannabis practitioner within s ixty (60) days immediately\npreceding the date of a renewal application.","path":["KRS Chapter 218B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55796","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:31Z","sha256":"03453d65a45ade98f3ef0083b070cc32ea53ed6fa41f828ff61afdba3fc70af9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-218b.050","next":"us-ky/krs-218b.060"},"notice":"GroundRules: Original legal text.
