{"data":{"id":"us-ky/krs-218b.070","jurisdiction":"us-ky","citation":"KRS 218B.070","heading":"Cardholder required notifications to cabinet -- Return of unused","body":"cannabis -- Expiration of protections.\n(1) Cardholders shall be required to make the following notifications to the cabinet:\n(a) A cardholder shall notify the cabin et of any change in his or her name or\naddress;\n(b) A registered qualified patient shall notify the cabinet within thirty (30) days if\nhe or she ceases to suffer from the medical condition for which a medicinal\ncannabis practitioner provided a written certification;\n(c) A registered qualified patient shall notify the cabinet if he or she wishes to\nterminate a designated caregiver relationship with an individual who has been\ndesignated as his or her caregiver;\n(d) A designated caregiver shall notify the cabi net within thirty (30) days if he or\nshe becomes aware that a registered qualified patient to whom the caregiver is\nconnected through the cabinet's registration process has died or has ceased to\nsuffer from the medical condition for which a medicinal canna bis practitioner\nprovided a written certification; and\n(e) If a cardholder loses his or her registry identification card, he or she shall\nnotify the cabinet within ten (10) days of becoming aware the card has been\nlost.\n(2) When a cardholder notifies the c abinet of items listed in paragraph (b) or (d) of\nsubsection (1) of this section, the cardholder shall, within ten (10) days of\nnotification, return any unused medicinal cannabis products to a licensed dispensary\nfor destruction.\n(3) When a cardholder notifies the cabinet of items listed in paragraph (a), (c), or (e) of\nsubsection (1) of this section, but remains eligible under this chapter, the cabinet\nshall issue the cardholder a new registry identification card with a new random ten\n(10) character alphan umeric identification number. If the cabinet issues a new\nregistry identification card to a registered qualified patient, the cabinet shall also\nissue a new registry identification card with a new ten (10) character alphanumeric\nnumber to the registered qu alified patient's designated caregiver. New registry\nidentification cards issued under this subsection shall be issued by the cabinet\nwithin ten (10) days of receiving the updated information.\n(4) If a registered qualified patient ceases to be a registered qualified patient or changes\nhis or her designated caregiver, the cabinet shall promptly notify the designated\ncaregiver in writing. The designated caregiver's protections under this chapter as to\nthat registered qualified patient shall expire fifteen (15 ) days after notification by\nthe cabinet.\n(5) (a) A medicinal cannabis practitioner who provided a written certification to a\npatient shall, within thirty (30) days of having knowledge of the facts, notify\nthe cabinet in writing that the registered qualifi ed patient has died, ceased to\nsuffer from the medical condition for which a medicinal cannabis practitioner\nprovided a written certification, or that the medicinal cannabis practitioner no\nlonger believes the patient is likely to receive safe and effectiv e therapeutic or\npalliative benefit from the use of medicinal cannabis.\n(b) If the cabinet receives written notification required by paragraph (a) of this\nsubsection, the cabinet shall promptly notify the registered qualified patient in\nwriting. The registered qualified patient's protections under this chapter shall\nexpire fifteen  (15) days after notification by the cabinet, and the registered\nqualified patient shall have fifteen (15) days to dispose of or donate his or her\nmedicinal cannabis to a dispensary.","path":["KRS Chapter 218B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55798","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:31Z","sha256":"e27b94f9c1161f5212577898cdc0d113209366f80db1b54f828f58e96e85b0f8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-218b.065","next":"us-ky/krs-218b.075"},"notice":"GroundRules: Original legal text.
