{"data":{"id":"us-ky/krs-218b.080","jurisdiction":"us-ky","citation":"KRS 218B.080","heading":"License required -- License types -- Initial one-year term -- Renewal.","body":"(1) No person shall cultivate, process, produce, possess, test, transfer, transport, or sell\nmedicinal cannabis or otherwise operate a cannabis business in this state wit hout\nfirst obtaining a license under this section.\n(2) The cabinet shall create separate licenses, licensure application fees, initial\nlicensure fees, and licensure renewal fees allowing persons to operate a cannabis\nbusiness, pursuant to this chapter and any administrative regulations promulgated\nthereunder, as a:\n(a) Tier I cannabis cultivator;\n(b) Tier II cannabis cultivator;\n(c) Tier III cannabis cultivator;\n(d) Tier IV cannabis cultivator;\n(e) Cannabis dispensary;\n(f) Cannabis processor;\n(g) Cannabis producer; or\n(h) Cannabis safety compliance facility.\n(3) Licensure application fees, initial licensing fees, and licensure renewal fees\ncollected by the cabinet pursuant to this section shall be retained by the cabinet for\nadministrative purposes.\n(4) (a) Except as provided in paragraph (b) of this subsection, a cann abis business\nshall be required to apply for and obtain from the cabinet a separate license\nfor each location it intends to operate.\n(b) A cannabis business licensed as a producer may operate cultivation and\nprocessing activities at separate locations, but  shall not operate more than one\n(1) cultivation and one (1) processing facility per license.\n(5) (a) A cannabis business license issued under this section and KRS 218B.085 and\n218B.090 shall be valid for one (1) year from the date of issuance. The\ncabinet shall notify each licensee ninety (90) days prior to the date the license\nexpires to allow the licensee to begin the renewal process established by the\ncabinet pursuant to KRS 218B.140.\n(b) The renewal of a cannabis business license shall be contingent up on\nsuccessful achievement of minimal performance standards established by the\ncabinet as part of the biennial accreditation process established by the cabinet\npursuant to KRS 218B.140.\n(6) The cabinet shall approve a license holder's sale of a license issu ed pursuant to this\nsection and KRS 218B.085 and 218B.090 if the purchaser and any new facilities\nmeet the requirements of this chapter.","path":["KRS Chapter 218B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54038","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:31Z","sha256":"de8876972eb09239c226ad6deee6397ef5faeecd1c923b1582b1280ef59bb6b9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-218b.075","next":"us-ky/krs-218b.085"},"notice":"GroundRules: Original legal text.
