{"data":{"id":"us-ky/krs-219.380","jurisdiction":"us-ky","citation":"KRS 219.380","heading":"Powers of cabinet and local health departments -- Duties of public","body":"prosecutors.\n(1) The cabinet may administer the provisions of KRS 219.310 to 219.410 through the\nrespective local health department concerned. Officials and employees of the\ncabinet and of local health departments are empowered to enter upon the premises\nof any community at any reasonable time for the purposes set forth in KRS 219.310\nto 219.410.\n(2) The cabinet or local health department concerned, after notice to the applicant or\nholder of a permit to operate, construct, or alter a community, and after an\nopportunity for a hearing, is authorized to deny, suspend, or revoke a permit in any\ncase where it finds that there has been a failure to comply with the requirements\nestablished unde r KRS 219.310 to 219.410 or the administrative regulations\npromulgated by the secretary. Hearings shall be in accordance with KRS Chapter\n13B.\n(3) It shall be the duty of each Commonwealth's attorney, county attorney, city attorney,\nor Attorney General within their respective jurisdiction to whom the cabinet or local\nhealth department or its agents report any violation of KRS 219.310 to 219.410, to\nenforce the provisions of KRS 219.310 to 219.410.\n(4) Nothing in KRS 219.310 to 219.410 shall be construed as requiring the cabinet or\nlocal health department to report for the institution of proceedings under KRS\n219.310 to 219.410, violations of KRS 219.310 to 219.410, whenever the cabinet or\nlocal health department concerned believes that the public interest wi ll be\nadequately served in the circumstances by a suitable written order.\n(5) Notwithstanding the existence or pursuit of any other civil or criminal remedy, the\ncabinet or local health department concerned may maintain, in its own name, an\naction to restrain or enjoin any violation of KRS 219.310 to 219.410, irrespective of\nwhether or not there exists an adequate remedy at law.","path":["KRS Chapter 219"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9761","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:32Z","sha256":"e7c6b96b1d1359b076ac5a5bfaa42425cc4daaf95dd4c5d53edc298ee46b82ec","source_id":"us-ky","stale":false,"prev":"us-ky/krs-219.370","next":"us-ky/krs-219.390"},"notice":"GroundRules: Original legal text.
