{"data":{"id":"us-ky/krs-220.035","jurisdiction":"us-ky","citation":"KRS 220.035","heading":"Powers of fiscal court to be stated in ordinance -- Powers of county","body":"judges/executive in districts governed by KRS 220.135 -- Service charges, rates,\nand user fees in districts with more than 10,000 customer accounts governed\nby KRS 220.542.\n(1) A fiscal court may:\n(a) Review and approve, amend, or disapprove proposed district land\nacquisitions;\n(b) Review and approve, amend, or disapprove proposed district construction of\ncapital improvements;\n(c) Except as provided under KRS 220.542, review and appro ve, amend, or\ndisapprove proposed service charges or user fees not more than once in a\ntwelve (12) month period; and\n(d) Review and approve, amend, or disapprove the district's proposed budget.\n(2) In order to exercise any or all the powers enumerated in s ubsection (1) of this\nsection, the fiscal court shall adopt a county ordinance explicitly stating which of\nthe powers the fiscal court intends to exercise and setting forth the procedures by\nwhich the sanitation district shall submit plans and documentatio n for review and\napproval, amendment, or disapproval. The exercise of such powers shall become\neffective thirty (30) days following the effective date of the ordinance. In the case of\ndistricts lying in two (2) or more counties, no fiscal court shall exerc ise the powers\nenumerated in subsection (1) of this section until each fiscal court has adopted\nconforming ordinances stating the powers to be exercised.\n(3) In the case of districts lying in two (2) or more counties, the votes of the respective\nfiscal courts shall be weighted in the same manner as appointments to the district\nboard are apportioned pursuant to KRS 220.140.\n(4) In the case of districts governed by the provisions of KRS 220.135, the county\njudges/executive shall exercise the powers listed in subsection (1) of this section.\nThey shall meet jointly at least once each fiscal year to exercise these powers. Their\nvotes shall be equally weighted. Service charges, rates, and user fees for districts\nwith more than ten thousand (10,000) customer accoun ts shall be approved as set\nout in KRS 220.542.\n(5) Service charges, rates, and user fees in districts not governed by the provisions of\nKRS 220.135 or having more than ten thousand (10,000) customer accounts shall\nbe approved as set out in KRS 220.542.","path":["KRS Chapter 220"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39891","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:32Z","sha256":"5da78d6df6b5b4139ca83fe007e995fdfaa58fe6c92c47e28717d8442b57c922","source_id":"us-ky","stale":false,"prev":"us-ky/krs-220.030","next":"us-ky/krs-220.040"},"notice":"GroundRules: Original legal text.
