{"data":{"id":"us-ky/krs-220.080","jurisdiction":"us-ky","citation":"KRS 220.080","heading":"Boundary of proposed district -- Investigation -- Change -- Inclusion of","body":"city property restricted.\n(1) When the petition is filed with the commissioner, he shall investigate at once the\nboundary of the district proposed to be organized, and may, at the cost of the\npetitioners, cause to be made surveys necessary to establish with reasonable\naccuracy a boundary that will, in his judgment, accomplish the purpose sought by\nthe creation of the district in a practicable and workable manner, and that will b e\nsufficiently comprehensive to avoid confusion or interference with any other similar\ndistrict then existing or that may be created. The boundary established by the\ncommissioner need not follow the boundary proposed by the petitioners, but if the\nboundary established by the commissioner results in a material change from that\nproposed in the original petition the petitioners shall secure, in case of a larger or\nsmaller area, the signatures of sixty percent (60%) of the freeholders or owners in\nthe area as established by the commissioner.\n(2) None of the provisions of KRS 220.010 to 220.520 shall be applicable within the\ncorporate boundary of any city of the first class, nor shall they be binding upon such\ncity or any part thereof, or any land or property wit hin the boundary of such city.\nThe governing body of any city of the first class shall determine by ordinance\nwhether city property lying outside the corporate boundary shall be included in any\nsanitation district, and whether the city shall bind itself to  pay the charges for the\nservices of the district furnished to such land or property.\n(3) Should it be found desirable to include in a sanitation district all or a portion of a\ncity with a population equal to or greater than eight thousand (8,000) but less  than\none hundred thousand (100,000) based upon the most recent federal decennial\ncensus, the governing body of such city shall determine by ordinance whether the\ncity or portion thereof shall be included in the district, or whether the city shall bind\nitself to pay the charges for the services of the district furnished in such area.","path":["KRS Chapter 220"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43862","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:32Z","sha256":"4d2296e631c3074410eef3a10142526aaa2232afc449259790810fd3f2cbd65e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-220.070","next":"us-ky/krs-220.090"},"notice":"GroundRules: Original legal text.
