{"data":{"id":"us-ky/krs-220.110","jurisdiction":"us-ky","citation":"KRS 220.110","heading":"Declaration and certification of organization -- Status and powers of","body":"district -- Corporate name.\n(1) If no suit is filed against the commissioner under KRS 220.100, or if suit is filed\nand final judgment in the Circuit Court or an appeal is in favor of the commissioner,\nthe commissioner shall forthwith declare the district organized into a sanitation\ndistrict and give it a corporate name, as provided in KRS 220.050, by which in all\nproceedings it shall thereafter be known. The commissioner shall certi fy his act to\nthe county clerk of each county in which any part of the district is located, and to\nthe Secretary of State, each of whom shall record the certificate as articles of\nincorporation. The commissioner shall also certify his act to the county\njudge/executive of each county in which any part of the district is located. The\ndistrict shall then be a political subdivision, except as otherwise specifically\nprovided in KRS 220.530, with power to sue and be sued, contract and be\ncontracted with, incur li abilities and obligations, exercise the right of eminent\ndomain, assess, tax, and contract for rentals as herein provided, issue bonds, and do\nand perform all acts herein expressly authorized and all acts necessary and proper\nfor the carrying out of the pu rpose for which the district was created, and for\nexecuting the powers with which it is invested.\n(2) The board of directors of the district may amend the corporate name of the district,\nbut the amendment shall not be effective until certified by the board  to the\ncommissioner, the county clerk and county judge/executive of each county in which\nany part of the district is located, and to the Secretary of State.","path":["KRS Chapter 220"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9778","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:32Z","sha256":"9b3f26a2d7a7c0851cdb308c174b70a8679bfdf4ba9888a24e114f8b4ee7e09e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-220.100","next":"us-ky/krs-220.115"},"notice":"GroundRules: Original legal text.
