{"data":{"id":"us-ky/krs-220.320","jurisdiction":"us-ky","citation":"KRS 220.320","heading":"Regulations as to use and construction of works and improvements --","body":"Enforcement -- Penalties and damages.\nWhere necessary in order to secure the best results from the construction, operation, and\nmaintenance of the works and improvements of the distri ct or construction subdistricts\nand to prevent their damage from misuse, the board of directors may make and enforce\nregulations pertaining to the use by persons and public corporations of the works and\nimprovements of the district or construction subdistr icts. Such regulations may prescribe\nthe design, construction and use of sewers within the district or construction subdistricts\nand the manner in which connections to laterals, trunk sewers, intercepting sewers and to\nother works of the district or constr uction subdistricts shall be made, may prevent the\nunnecessary pollution of any watercourse or supply within the district or construction\nsubdistricts and may prohibit the discharge into such sewers of any wastes deemed\ndetrimental to the works and improve ments of the district or construction subdistricts.\nSuch regulations shall have no effect until approved by the Energy and Environment\nCabinet. The board may recover by civil action from any person or public corporation\nviolating such regulations, a sum no t less than one hundred dollars ($100) nor more than\none thousand dollars ($1,000) for each offense, together with costs. The directors may\nenforce by mandamus or otherwise all necessary and authorized regulations made by\nthem, and may remove any improper construction or close any connections made\nimproperly or in violation of the regulations.
