{"data":{"id":"us-ky/krs-222.005","jurisdiction":"us-ky","citation":"KRS 222.005","heading":"Definitions for chapter.","body":"As used in this chapter, unless the context otherwise requires:\n(1) \"Administrator\" means the person or the designee of the person, in charge of the\noperation of substance use disorder prevention, intervention, or treatment program;\n(2) \"Agency\" means a le gal entity operating hospital -based or nonhospital -based\nsubstance use disorder prevention, intervention, or treatment programs;\n(3) \"Cabinet\" means the Cabinet for Health and Family Services;\n(4) \"Director\" means the director of the Division of Behavioral  Health of the\nDepartment for Behavioral Health, Developmental and Intellectual Disabilities;\n(5) \"Hospital\" means an establishment with organized medical staff and permanent\nfacilities with inpatient beds which provide medical services, including physicia n\nservices and continuous nursing services for the diagnosis and treatment of patients\nwho have a variety of medical conditions, both surgical and nonsurgical;\n(6)) \"Intoxication\" means being under the influence of alcohol or other drugs, or both,\nwhich significantly impairs a person's ability to function;\n(7) \"Narcotic treatment program\" means a substance use disorder program using\napproved controlled substances and offering a range of treatment procedures and\nservices for the rehabilitation of persons dep endent on opium, morphine, heroin, or\nany derivative or synthetic drug of that group;\n(8) \"Other drugs\" means controlled substances as defined in KRS Chapter 218A and\nvolatile substances as defined in KRS 217.900;\n(9) \"Patient\" means any person admitted to  a hospital or a licensed substance use\ndisorder treatment program;\n(10) \"Program\" means a set of services rendered directly to the public that is organized\naround a common goal of either preventing, intervening, or treating substance use\ndisorder problems;\n(11) \"Secretary\" means the secretary of the Cabinet for Health and Family Services;\n(12) \"Substance use disorder\" means a cluster of cognitive, behavioral, and physiological\nsymptoms indicating that the individual continues using the substance despite\nsignificant substance-related problems. Criteria for substance use disorder are in the\nmost current edition of the American Psychiatric Association's Diagnostic and\nStatistical Manual of Mental Disorders;\n(13) \"Treatment\" means services and programs for the care and rehabilitation of\nintoxicated persons and persons suffering from substance use disorder. \"Treatment\"\nincludes those services provided by the cabinet in KRS 222.211 and, in KRS\n222.430 to 222.437, it specifically includes the services described in KRS\n222.211(1)(c) and (d); and\n(14) \"Qualified health professional\" has the same meaning as qualified mental health\nprofessional in KRS 202A.011, except that it also includes an alcohol and drug\ncounselor licensed or certified under KRS Chapter 309.","path":["KRS Chapter 222"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48988","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:33Z","sha256":"8a37d8b16ce59e2463020bea7c685776cf8ea23ab642e2f7043a069b0f24c9bb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-222.003","next":"us-ky/krs-222.010"},"notice":"GroundRules: Original legal text.
