{"data":{"id":"us-ky/krs-222.203","jurisdiction":"us-ky","citation":"KRS 222.203","heading":"Arrest -- Citation -- Jail -- Bail -- Pretrial release.","body":"(1) A peace officer may make an arrest for a violation of KRS 222.202.\n(2) Any peace officer who arrests a person for violation of KRS 222.202 shall take him\nto jail. A peace officer may issue a citation and may take the person to a facility\nauthorized by county or city ordinance agreeing to care for the person. If the person\nis jailed, at the jail it shall be determined if the person has committed a previous\noffense under KRS 222.202.\n(3) A citation shall be issued to such person showing thereon the date of su ch person's\nappearance in court and whether the offense is prepayable or not.\n(4) Unless it has been determined that the defendant has had two (2) prior convictions\nfor violation of KRS 222.202 within the previous twelve (12) months, the citation\nshall be marked as prepayable.\n(5) If it is determined that this is a third or subsequent offense, then the provisions of\nKRS Chapter 431 with regard to bail and pretrial release shall apply.","path":["KRS Chapter 222"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9916","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:33Z","sha256":"c416b86b9090b7ae6a72365e59b7c0c42dd12f44fab7947242b9d33aec613f90","source_id":"us-ky","stale":false,"prev":"us-ky/krs-222.202","next":"us-ky/krs-222.204"},"notice":"GroundRules: Original legal text.
