{"data":{"id":"us-ky/krs-222.211","jurisdiction":"us-ky","citation":"KRS 222.211","heading":"Cabinet's functions as to nicotine dependence and substance use disorder -","body":"- Authority for administrative regulations -- Required services.\n(1) The cabinet shall, in conjunction with the Office of Drug Control Policy and KY -\nASAP and in furtheran ce of the strategic plan developed in KRS 15A.342,\ncoordinate matters affecting nicotine dependence and substance use disorder in the\nCommonwealth and shall assure that there is the provision of prevention,\nintervention, and treatment services for individu als under age eighteen (18) years\nand adults to address the problems of nicotine dependence and substance use\ndisorder within individuals, families, and communities; that the coordination of\nthese matters shall be done in cooperation with public and privat e agencies,\nbusiness, and industry; and that technical assistance, training, and consultation\nservices shall be provided within budgetary limitations when required. The cabinet\nmay promulgate administrative regulations under KRS Chapter 13A to carry out it s\npowers and duties under this chapter. The cabinet shall utilize community mental\nhealth centers and existing facilities and services within the private sector when\npossible. The cabinet shall be responsible for assuring that the following services\nare available:\n(a) Primary prevention services directed to the general population and identified\ntarget groups for the purposes of avoiding the onset of nicotine dependence\nand substance use disorder related problems and enhancing the general level\nof health of the target groups. The purpose of the services shall be to provide\nindividuals with the information and skills necessary to make healthy\ndecisions regarding the use or nonuse of tobacco and nicotine products,\nalcohol, and other drugs as well as to influenc e environmental factors, such as\nsocial policies and norms which will support healthy lifestyle;\n(b) Intervention services for the purpose of identifying, motivating, and referring\nindividuals in need of nicotine dependence and substance use disorder\neducation or treatment services. Services may be provided in settings such as\nindustry and business, schools, health, and social service agencies;\n(c) Withdrawal management services on a twenty -four (24) hour basis in or near\npopulation centers which meet the i mmediate medical and physical needs of\npersons intoxicated from the use of alcohol or drugs, or both, including\nnecessary diagnostic and referral services. The services shall be provided in\neither a hospital or a licensed substance use disorder program;\n(d) Substance use disorder treatment services offered on an inpatient or outpatient\nbasis for the purposes of treating an individual's substance use disorder. The\nservices shall be provided in a licensed substance use disorder program;\n(e) Therapeutic services to family members and significant others of individuals\nwith a substance use disorder for the purpose of reducing or eliminating\ndysfunctional behavior that may occur within individuals who are\nemotionally, socially, and sometimes physically dependent o n an individual\nwith a substance use disorder. The services shall be offered primarily on an\noutpatient basis;\n(f) Inpatient psychiatric services for those individuals with a substance use\ndisorder whose diagnosis reflects both serious mental illness as we ll as a\nsubstance use disorder;\n(g) Training programs for personnel working in the field of prevention,\nintervention, and treatment of nicotine dependence and substance use\ndisorders; and\n(h) Driving under the influence services to include assessment, educ ation, and\ntreatment for persons convicted of operating a motor vehicle, while under the\ninfluence of alcohol or other substance which may impair driving ability,\npursuant to KRS Chapter 189A.\n(2) The cabinet shall comply with all policy recommendations of  the Office of Drug\nControl Policy and KY -ASAP, and shall honor requests for information from the\nOffice of Drug Control Policy created under KRS 15A.020.","path":["KRS Chapter 222"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48989","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:34Z","sha256":"3eba20c8f6cdb855ccc017e421f3630a5bc115e782e8fcea3f7bd2fbb192e7d4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-222.210","next":"us-ky/krs-222.212"},"notice":"GroundRules: Original legal text.
