{"data":{"id":"us-ky/krs-222.221","jurisdiction":"us-ky","citation":"KRS 222.221","heading":"Administrative powers of cabinet.","body":"The cabinet may:\n(1) Make and enter into all contracts and agreements necessary or incidental to the\nperformance of its duties and the execution of its powers under this chapter,\nincluding but not limited to contracts with government departments, public and\nprivate agencies an d facilities, physicians, and other persons rendering services to\nindividuals with a substance use disorder. All rates shall be established in\naccordance with administrative regulations promulgated by the cabinet under KRS\nChapter 13A. Income and resources  of individuals with a substance use disorder to\npay for services shall be taken into consideration to the fullest extent possible, and\nthe cabinet shall be subrogated to any public or private third -party payments which\nmay be due;\n(2) Establish and operat e facilities if adequate public and private resources are not\navailable;\n(3) Solicit and accept for use in relation to the purposes of this chapter any gift or\nbequest of money or property and any grant or loans of money, services, or property\nfrom the fed eral government, the Commonwealth or any political subdivision\nthereof. Any money received under this paragraph shall be deposited in the State\nTreasury to be kept in a separate fund which is hereby created, for expenditure by\nthe cabinet in accordance wit h the conditions of the gift, bequest, loan, or grant\nwithout specific appropriations; and\n(4) Promulgate administrative regulations pursuant to KRS Chapter 13A setting\nstandards for the admission of patients to its facilities and set fees for treatment.\nExcept as otherwise provided by law, all provisions of KRS Chapter 210 relating to\ncharges and collection for treatment of individuals with a mental illness shall apply\nto fees and collection of fees for treatment of individuals with a substance use\ndisorder.","path":["KRS Chapter 222"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48990","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:34Z","sha256":"9fea96e5dd7e127b52c30b0f8125fd3b5eeee8e77d87e70e43e36e88467ffcf4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-222.220","next":"us-ky/krs-222.230"},"notice":"GroundRules: Original legal text.
