{"data":{"id":"us-ky/krs-222.233","jurisdiction":"us-ky","citation":"KRS 222.233","heading":"Administrative regulations regarding peer support specialists, counselors,","body":"case managers, and community support associates -- Prohibition of\npsychoeducational services.\nThe Cabinet for Health and Family Services shall promulgate administrativ e regulations\nin accordance with KRS Chapter 13A to:\n(1) Require that:\n(a) Until January 1, 2027, licensed alcohol and other drug treatment entities,\nbehavioral health service organizations, behavioral health multi -specialty\ngroups, and any entities that b ill for peer support services that employ an\nalcohol and drug peer support specialist only employ an alcohol and drug peer\nsupport specialist who is either registered under KRS 309.0831 or meets the\nrequirements of applicable administrative regulations in effect on or after July\n15, 2024; and\n(b) Beginning January 1, 2027, licensed alcohol and other drug treatment entities,\nbehavioral health service organizations, behavioral health multi -specialty\ngroups, and any entities that bill for peer support services  that employ an\nalcohol and drug peer support specialist only employ an alcohol and drug peer\nsupport specialist who is registered under KRS 309.0831;\n(2) Require that a licensed alcohol and drug counselor or a licensed clinical alcohol or\ndrug counselor b e a reimbursable service provider in alcohol and other drug\ntreatment entities and behavioral health service organizations;\n(3) Permit the qualifications for a case manager for an individual with mental or\nsubstance use disorder to be a bachelor's degree o r higher in any field of study and\nset forth training and supervision requirements to substitute for required work\nexperience;\n(4) Require a community support associate approved by the Department for Behavioral\nHealth, Developmental and Intellectual Disabi lities to be a reimbursable service\nprovider in licensed alcohol and other drug treatment entities and behavioral health\nservice organizations;\n(5) Permit peer support specialists to provide services to groups of the same size as\nother licensed clinical pr ofessionals in a licensed alcohol and other drug treatment\nentities and behavioral health service organizations; and\n(6) Prohibit alcohol and drug peer support specialists employed by behavioral health\nservice organizations, behavioral health multi -specialty groups, or entities that bill\nfor peer support services from providing psychoeducational services in individual\nor group settings.","path":["KRS Chapter 222"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56831","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:34Z","sha256":"822950c1073a567327e3d75009b07fb1f5048c2dd963b9ea87833c42ef98b3cb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-222.232","next":"us-ky/krs-222.234"},"notice":"GroundRules: Original legal text.
