{"data":{"id":"us-ky/krs-222.427","jurisdiction":"us-ky","citation":"KRS 222.427","heading":"Definitions -- Cabinet to publish list of qualified treatment programs in","body":"state -- Prioritization in criminal cases -- Administrative regulations.\n(1) As used in this section:\n(a) \"Department\" means the Department of Public Advocacy;\n(b) \"Qualified treatment program\" means a treatment program that shall:\n1. Meet, at a minimum, one (1) the following requirements:\na. Meet licensure requirements and standards established by the\nCabinet for Health and Family Services under KRS Chapter 222;\nb. Be c ertified by a state affiliate of the National Alliance of\nRecovery Residences as a level III or IV Recovery Residence;\nc. Be designated by the Kentucky Housing Corporation as a\nRecovery Kentucky Center;\nd. Meet alternative and relevant licensure or certifi cation criteria\nrecognized by the cabinet or a federal agency; or\ne. Be accredited by at least one (1) of the following:\ni. American Society of Addiction Medicine (ASAM);\nii. Joint Commission on Accreditation of Healthcare\nOrganizations;\niii. Commission on Accreditation of Rehabilitation Facilities\n(CARF);\niv. The Council on Accreditation; or\nv. Other accreditations, certifications, or standards recognized\nby the Cabinet for Health and Family Services;\n2. If providing medical or clinical behavioral health services, be enrolled\nas a Medicaid -approved provider or enrolled with a private insurer and\nbe eligible to bill and receive reimbursement for behavioral health\nservices;\n3. Have at least two (2) years of experience as an agency administering\nevidence-based substance use disorder treatment services and recovery\nsupport services; and\n4. Provide or have a protocol to refer clients to agencies or prescribers that\nprovide medications for opioid use disorder, including but not limited to\nmethadone, buprenorphine, or naltrexone; and\n(c) \"Treatment program\" means any substance use program licensed, regulated,\nor defined in KRS Chapter 222 and a substance use disorder program that\nholds a chemical dependency treatment services license under KRS 222.231\nthat was issued in accordance with KRS 216B.042.\n(2) The cabinet shall publish a list on the cabinet's website of all qualified treatment\nprograms in the state and shall provide the list to the department and to the\nAdministrative Office of the Courts.\n(3) Any employee of the Commonwealth who makes a recommendation to a court in a\ncriminal case for an alternative sentence that includes services to address an\nindividual's substance use diso rder shall be required to prioritize referrals to a\nqualified treatment program by the cabinet. If the employee recommends probation,\nconditional discharge, or an alternative sentence that includes services that are to be\nprovided by a facility or provider  that is not a qualified treatment program, the\nemployee shall inform the court in writing or on the record of the alternative\nsentencing plan and the reason for not including services provided by a qualified\ntreatment program.\n(4) By January 1, 2025, the cabinet shall promulgate regulations in accordance with\nKRS Chapter 13A to require a treatment program or a premise, place, or building\nthat holds itself out as a treatment program for recovery from the use of intoxicating\nsubstances to clearly and conspic uously provide full disclosure of the specific\nservices provided by the treatment program to any potential residents and in any\nadvertisements or other solicitations. The disclosure shall clearly and conspicuously\ninclude the level of care provided by the treatment program regarding the\nfollowing:\n(a) Provision of room and board;\n(b) Level of medical services;\n(c) Level of clinical services;\n(d) Staffing; and\n(e) Accreditation.","path":["KRS Chapter 222"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54922","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:34Z","sha256":"edad6c6d6492a882cea717329c5244a7bfd5af21cbfdcff0f25b1612702b1ddc","source_id":"us-ky","stale":false,"prev":"us-ky/krs-222.425","next":"us-ky/krs-222.429"},"notice":"GroundRules: Original legal text.
