{"data":{"id":"us-ky/krs-222.434","jurisdiction":"us-ky","citation":"KRS 222.434","heading":"Seventy-two-hour emergency involuntary treatment.","body":"(1) Following an examination by a qualified health professional and a certification by\nthat professional that the person meets the criteria specified in KRS 222.431, the\ncourt may order the person hospitalized for a period not to exceed seventy -two (72)\nhours if the court finds, by clear and convincing evidence, that the respondent\npresents an imminent threat of danger to self, family, or others as a result of a\nsubstance use disorder.\n(2) Any person who has been admitted to a hospital under subsection (1) of t his section\nshall be released from the hospital within seventy-two (72) hours of admittance.\n(3) No respondent ordered hospitalized under this section shall be held in jail pending\ntransportation to the hospital or evaluation unless the court has previousl y found the\nrespondent to be in contempt of court for either failure to undergo treatment or\nfailure to appear at the evaluation ordered pursuant to KRS 222.433.","path":["KRS Chapter 222"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48999","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:34Z","sha256":"299834e0028e9947c39dca4f34aff4343d6fa71b2efd03540e00adb5e3c29a91","source_id":"us-ky","stale":false,"prev":"us-ky/krs-222.433","next":"us-ky/krs-222.435"},"notice":"GroundRules: Original legal text.
