{"data":{"id":"us-ky/krs-223.400","jurisdiction":"us-ky","citation":"KRS 223.400","heading":"Definitions for KRS 223.405 to 223.460.","body":"As used in KRS 223.405 to 223.460, unless the context requires otherwise:\n(1) \"Alteration or repair of a water well\" means any maintenance, addition, or change of\nwell or pitless adapter, but does not include replacement or repair of a water pump\nor associated piping;\n(2) \"Board\" means the Kentucky Water Well Certification Board;\n(3) \"Cabinet\" means the Energy and Environment Cabinet;\n(4) \"Certificate\" means a certificate of competency issued by the secretary stating that\nthe water well driller has met all the requirements for the appropriate classification\nset forth in KRS 223.405 to 223.460 or by regulation;\n(5) \"Person\" means an individual, corporation, partnership, association, municipality,\nstate and federal government, or other public body or other leg al entity, or any\nofficer, employee, or agent of any of the foregoing;\n(6) \"Secretary\" means the secretary of the Energy and Environment Cabinet;\n(7) \"Water well\" or \"well\" means any excavation or opening in the surface of the earth\nthat is drilled, cored,  bored, washed, driven, jetted, or otherwise constructed when\nthe actual or intended use in whole or part of an excavation is the removal of water\nfor any purpose, including but not limited to culinary and household purposes,\nanimal consumption, food manuf acture, use of geothermal resources for domestic\nheating purposes and industrial, irrigation, and dewatering purposes, but not\nincluding wells to be used for watering stock or for general farmstead use if the\nwells do not provide water for human consumption;\n(8) \"Water well driller\" means a person who is qualified to engage in the drilling,\nalteration, or repair of a water well as defined in this chapter; and\n(9) \"Water well driller's assistant\" means a person who is qualified to engage in the\ndrilling, alt eration, or repair of a water well under the supervision of a certified\nwater well driller who provided the affidavit of supervision required under KRS\n223.425(5)(g).","path":["KRS Chapter 223"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48579","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:34Z","sha256":"82012fb82ba32401ad2aada283fd0994bc63f5e7592b66a9168400b3e806546e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-223.220","next":"us-ky/krs-223.405"},"notice":"GroundRules: Original legal text.
