{"data":{"id":"us-ky/krs-223.425","jurisdiction":"us-ky","citation":"KRS 223.425","heading":"Application for certificate or renewal -- Qualifications of water well driller","body":"-- Limited exemption for users of divining rods -- Term of certificate -- Water\nwell driller's assistant card -- Supervision of assistants -- Administrative\nregulations.\n(1) Application for a certificate, or for renewal thereof, shall be made to the cabinet in\nwriting under oath or affirmation, upon forms prescribed and furnished by the\ncabinet. The applications shall include:\n(a) The name and address of the applicant;\n(b) Prior experience, if any, in the field for which the applicant is applying;\n(c) Any other information that the cabinet deems necessary in order to carry out\nthe provisions of KRS 223.405 to 223.460; and\n(d) All past and current licenses held in this or any other state relating to the\nprovisions of KRS 223.405 to 223.460.\n(2) The cabinet may issue a water well driller certificate to any applicant who meets all\nof the provisions of KRS 223.405 to 223.460 and:\n(a) Is at least eighteen (18) years of age; and\n(b) Is legally permitted to work in the United States; and\n(c) Has worked for two (2) years under the supervision of a certified water well\ndriller or has other suitable experience or education as determined by the\ncabinet. For those in business on Jul y 13, 1984, the two (2) year experience\nrequirement shall be deemed satisfied if the driller has engaged in water well\ndrilling, over the two (2) previous years; and\n(d) Has a passing grade on the examination as determined by the cabinet.\n(3) Those persons who are water witchers, dowsers, diviners, and any others who use\ndivining rods for the purpose of locating underground water resources shall be\nexempt from KRS 223.405 to 223.460 for the purpose of locating underground\nwater resources, but are not exempt  from the requirements of KRS 223.405 to\n223.460 for the purpose of installing water wells.\n(4) The term of each certificate shall be one (1) year. Each certificate shall carry with it\nthe right to successive renewal upon application and payment of fee, un less the\nboard finds that the certified individual has failed to comply satisfactorily with KRS\n223.405 to 223.460 or the regulations promulgated pursuant to KRS 223.420 or\n223.435.\n(5) Application for a certified water well driller's assistant card shall be made on forms\nprescribed and furnished by the cabinet. Applications shall include the following\ninformation:\n(a) Name and address of the applicant;\n(b) Prior experience, if any, in the field for which the applicant is applying;\n(c) Past and current licenses held in the Commonwealth or any other state that\nrelates to KRS 223.405 to 223.460;\n(d) Proof that the applicant is at least eighteen (18) years of age;\n(e) Proof that the applicant is legally permitted to work in the United States;\n(f) Proof that the applicant has a passing grade on examinations required by the\ncabinet;\n(g) An affidavit of supervision signed by the certified water well driller, which\nshall include, at a minimum, the following information:\n1. The name and certification number of the certified water well driller;\n2. The name of the company under which the certified water well driller\nworks;\n3. The name and address of the certified water well driller's assistant to be\nsupervised under the company identified in subpara graph 2. of this\nparagraph;\n4. The effective date when supervision is to begin, and a statement that\nsupervision shall remain in effect until such time as the certified water\nwell driller provides written notice to the Division of Water and the\nwater well driller's assistant of the termination of supervision;\n5. The types of duties or operations to be performed by the water well\ndriller's assistant while under supervision of the certified water well\ndriller, and a statement that the work to be performed sha ll be in\naccordance with all applicable statutes and administrative regulations;\nand\n6. Notarized signatures of the certified water well driller and the certified\nwater well driller's assistants; and\n(h) Any other information that the cabinet deems necessa ry in order to carry out\nKRS 223.405 to 223.460.\n(6) The water well driller's assistant card shall be effective for one (1) year and shall be\nsubject to successive renewal upon submission of application and payment of\nprescribed fee by the cabinet unless:\n(a) The cabinet finds that the certified water well driller's assistant has failed to\ncomply with any of the provisions of KRS 223.405 to 223.460 or the\nadministrative regulations promulgated thereunder; or\n(b) The certified water well driller's assistant has failed to maintain an annual\nminimum of eight (8) hours of continuing education credits.\n(7) A certified water well driller is allowed to supervise a maximum of two (2) certified\nwater well driller's assistants at any given time.\n(8) The water well dri ller's assistant shall be under the certified water well driller's\ndirect supervision when constructing, modifying, abandoning, or testing a water\nwell.\n(9) The cabinet shall promulgate administrative regulations to establish the required\nforms, process, e xamination, fees, affidavit of supervision, requirements of direct\nsupervision by the certified driller, and any other requirements necessary for the\nimplementation of the water well driller's assistant certification program.","path":["KRS Chapter 223"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48581","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:34Z","sha256":"9e2d990f4c079e533ede01f0286e8838aea4c778baec6aea0d727e48d1593996","source_id":"us-ky","stale":false,"prev":"us-ky/krs-223.420","next":"us-ky/krs-223.430"},"notice":"GroundRules: Original legal text.
