{"data":{"id":"us-ky/krs-223.430","jurisdiction":"us-ky","citation":"KRS 223.430","heading":"Liability coverage -- Surety bond.","body":"(1) Each application for issuance or renewal of a certificate shall be accompanied by a\nproof of either split limits liability coverage for bodily injury of at least twenty -five\nthousand dollars ($25,000) per person with an aggregate of at least fifty thousand\ndollars ($50,000) and for property damage of at least fifty thousand dollars\n($50,000) per accident with an aggregate of at least one hundred thousand dollars\n($100,000), or single limits liability coverage of not less than one hundred thousand\ndollars ($100,000) for all damages whether arising out of bodily injury or damage to\nproperty as a result of any one (1) accident or occurrence. Notice shall be given by\ncertified mail to the executive secretary and treasurer of the board by the insurer\nupon lapse o f coverage by the insurance company for any reason, including\nnonpayment of premiums.\n(2) Prior to the issuance of a driller certificate, proof of a surety bond must be filed\nalong with the application for a certificate. The penal sum of this bond shall be  five\nthousand dollars ($5,000), with the applicant designated as the principal obligor and\nthe Commonwealth designated as the obligee. The surety may be called on by the\nsecretary if the certified individual violates any design standards adopted as\nadministrative regulations pursuant to KRS 223.420 or 223.435 or provision of\nKRS 223.405 to 223.460. The surety bond shall be used for the express purposes of\ncorrecting the violations. Notice of lapse of coverage for any reason by the surety\nshall be given by certified mail to the executive secretary and treasurer of the board\nby the surety.\n(3) A water well driller's assistant shall work under the liability insurance and surety\nbond of the supervising certified water well driller, as required under subsections\n(1) and (2) of this section, unless the water well driller's assistant provides the\ncabinet proof that he or she obtained liability insurance or a surety bond.","path":["KRS Chapter 223"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48582","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:34Z","sha256":"731fd5bf9acb0b4744ceba051c817a5d0b8f702c4748a799e31ca97f886be528","source_id":"us-ky","stale":false,"prev":"us-ky/krs-223.425","next":"us-ky/krs-223.435"},"notice":"GroundRules: Original legal text.
