{"data":{"id":"us-ky/krs-223.991","jurisdiction":"us-ky","citation":"KRS 223.991","heading":"Penalties.","body":"(1) Any person, firm or corporation (municipal or private) who violates any provisions\nof KRS 223.160 to 223.220 or the rules and regulations adopted thereunder shall be\nliable to a civil penalty not to exceed the sum of one thousand dollars ($1,000) for\nsaid violation and an additional civil penalty not to exceed one thousand dollars\n($1,000) for each day of operation in violation of KRS 223.160 to 223.220 or of the\nrules and regulations adopted thereunder. In addition, the person, firm or\ncorporation may be e njoined in the manner set forth in KRS Chapter 224 from\ncontinuing such violations.\n(2) Any person who fails to comply with the certification provisions of KRS 223.425\nshall be liable for a civil penalty of not less than two thousand five hundred dollars\n($2,500) and not more than five thousand dollars ($5,000) per occurrence, and in\naddition may be concurrently enjoined from any such violations as hereinafter\nprovided.\n(3) Any person certified under the provisions of KRS 223.425, who violates KRS\n223.405 to 223.460 or fails to perform any duties imposed by these sections, or who\nviolates any determination, rule, regulation or order or determination of the\nsecretary promulgated pursuant thereto may be subject to proceedings for certificate\nsuspension or revocation, or nonrenewal of a certificate.\n(4) It shall be the duty of the cabinet to institute an action for the recovery of the\npenalties herein provided for, and to bring an action for an injunction against any\nperson violating or threatening to violate th e certification provisions of KRS\n223.425 or violating or threatening to violate any order or determination of the\ncabinet promulgated pursuant thereto.\n(5) Any person found guilty of violating the certification provisions of KRS 223.425 or\nthe rules and r egulations adopted thereunder shall be guilty of a misdemeanor and\nmay be fined not less than one hundred dollars ($100) nor more than five hundred\ndollars ($500) for each violation or imprisoned not more than thirty (30) days or\nboth. Each day the violation continues shall be considered a separate violation.\n(6) Civil and criminal penalties shall not be deemed mutually exclusive.\n(7) All enforcement proceedings shall be conducted pursuant to KRS Chapter 224, and\nall certificate revocation and enforcement a ctions shall be subject to the\nadministrative and judicial procedures contained in KRS Chapter 224.","path":["KRS Chapter 223"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9988","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:35Z","sha256":"939fa4a510a4ff01042052d612e85a98e6ccc23110a67e1910ad33521f9e8317","source_id":"us-ky","stale":false,"prev":"us-ky/krs-223.990","next":"us-ky/krs-224.005"},"notice":"GroundRules: Original legal text.
