{"data":{"id":"us-ky/krs-224.1-050","jurisdiction":"us-ky","citation":"KRS 224.1-050","heading":"Failure to enforce law or regulations -- Demands for enforcement.","body":"Any citizen of this Commonwealth having knowledge that any of the provisions of this\nchapter or regulations adopted thereunder are willfully and deliberately not being\nenforced by any public officer or employee, whose duty it is to enforce such provisions of\nthis chapter and regulations thereunder, may bring such failure to enforce the law to the\nattention of such public officer or employee. To provide against unreasonable and\nirresponsible demands being made, all such demands to enforce the law must be in\nwriting, under oath, with facts set forth specifically stating the nature of the failure to\nenforce the law. The stating of false facts and charges in such affidavit shall constitute\nperjury and shall subject the affiant to penalties provided under the law of perjury. If such\npublic officer or employee neglects or refuses for any unreasonable time after demand to\nenforce such provision, any such citizen shall have the right to bring an action of\nmandamus in the Circuit Court of the county in which the opera tion which relates to the\nalleged lack of enforcement is being conducted. The court, if satisfied that any provision\nof this chapter or regulation thereunder is not being enforced, may make an appropriate\norder compelling the public officer or employee, wh ose duty it is to enforce such\nprovision, to perform his duties, and upon failure to do so such public officer or employee\nshall be held in contempt of court and shall be subject to the penalties provided by the\nlaws of the Commonwealth in such cases.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=41574","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:38Z","sha256":"930e77b2e54444d46f8ac7cfaf686cfb86080f2dd961ef1222c29758ef3a77eb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.1-040","next":"us-ky/krs-224.1-060"},"notice":"GroundRules: Original legal text.
