{"data":{"id":"us-ky/krs-224.1-300","jurisdiction":"us-ky","citation":"KRS 224.1-300","heading":"Definitions for KRS 224.1-300 and 224.1-310.","body":"For purposes of KRS 224.1-300 and 224.1-310 only:\n(1) \"Pollution control facility\" means and includes:\n(a) Any property designed, constructed, or installed as a component part of any\ncommercial or industrial premises for the primary purpose of eliminating or\nreducing the emission of, or ground level concentration of, particulate matter,\ndust, fumes, gas, mist, smoke, vapor, or odorous substances, or any\ncombination thereof which renders air harmful or inimical to the health of\npersons or to property within this Commonwealth;\n(b) Any disposal system or any treatment works, pretreatment works, appliance,\nequipment, machinery, or installation constructed, used, or placed in operation\nprimarily for the purpose of reducing, controlling, or eliminating thermal\npollution or water pollution caused by industrial waste, or what would be\nindustrial waste, if discharged into the waters of the Commonwealth;\n(c) Any disposal system or any appliance, equipment, machinery or installation\nconstructed, used or placed in operat ion primarily for disposing of waste,\nconverting waste into an item of real economic value or converting hazardous\nwaste to nonhazardous waste;\n(d) Any property designed, constructed, or installed as a component part of any\ncommercial or industrial premise s for the primary purpose of eliminating or\nreducing the emission of sound which is harmful or inimical to the health of\npersons or to property, or materially reduces the quality of the environment in\nthis Commonwealth; or\n(e) Any property designed, constr ucted, or installed for the primary purpose of\nremoving substances from raw materials, which substances, if permitted to\nbecome a component part of the finished product, would have a deleterious\neffect on the environment when the finished product was utilized;\n(2) \"Industrial waste\" means any liquid, gaseous, or solid waste substance resulting\nfrom any process of industry, manufacture, trade, or business, or from the\ndevelopment, processing, or recovery of any natural resource, together with such\nsewage as is present, which pollutes the waters of the Commonwealth;\n(3) \"Solid waste\" means any garbage, refuse, sludge from a waste treatment plant,\nwater supply treatment plant, or air pollution control facility and other discarded\nmaterial, including solid, liquid, semi-solid, or contained gaseous material resulting\nfrom industrial, commercial, mining (excluding coal mining waste), and agricultural\noperations, and from community activities, but does not include solid or dissolved\nmaterial in domestic sewage, or s olid or dissolved materials in irrigation return\nflows or industrial discharges which are point sources subject to permits under\nSection 402 of the Federal Water Pollution Control Act, as amended (86 Stat. 880),\nor source, special nuclear, or by -product material as defined by the Atomic Energy\nAct of 1954, as amended (68 Stat. 923);\n(4) \"Treatment works\" means any plant, disposal field, lagoon, dam, pumpi ng station,\nincinerator, or other works used for the purpose of treating, stabilizing, or holding\nsewage, industrial waste, or other wastes;\n(5) \"Water pollution\" means the placing of any noxious or deleterious substances in\nany waters of the Commonwealth which render such waters harmful or inimical to\naquatic life, or to the use of such waters for domestic water supply, or industrial or\nagricultural purposes or for recreation;\n(6) \"Waters of the Commonwealth\" means all streams, lakes, ponds, marshes,\nwatercourses, waterways, wells, springs, irrigation systems, drainage systems, and\nall other bodies or accumulations of water, surface and underground, natural or\nartificial, which are situated wholly or partly within, or border upon, this\nCommonwealth, or are within its jurisdiction, except those private waters which do\nnot combine or effect a junction with natural surface or underground waters;\n(7) \"Cabinet\" means the Energy and Environment Cabinet; and\n(8) \"Pollution control tax exemption certificate\" means t hat certificate issued by the\ncabinet pursuant to KRS 224.1-310.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56015","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:38Z","sha256":"939a174e018a8b0037ab04ae3c9192a76cd8fbf076bd9b2b37014be22b3f7be4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.1-220","next":"us-ky/krs-224.1-310"},"notice":"GroundRules: Original legal text.
