{"data":{"id":"us-ky/krs-224.1-405","jurisdiction":"us-ky","citation":"KRS 224.1-405","heading":"Corrective action for release of petroleum or petroleum product from a","body":"source other than a petroleum storage tank.\n(1) In the event of a release to the environment of petroleum or a petroleum product\nfrom a source other than a petroleum storage tank, any person who owns or operates\nthe source from which the release occurred or any person who caused the release\nshall characterize the extent of the release as necessary to determine the effect of the\nrelease on the environment and shall perform correcti ve action. \"Corrective action\"\nmeans those actions necessary to protect human health, safety, and the environment\nin the event of a release of petroleum or petroleum product from a source other than\na petroleum storage tank. \"Corrective action\" includes re medial actions to clean up\ncontaminated groundwater, surface waters, sediments, and soil; actions to address\nresidual effects after initial corrective action is taken; and actions taken to restore or\nreplace potable water supplies. \"Corrective action\" also  includes actions necessary\nto monitor, assess, and evaluate a release, as well as actions necessary to monitor,\nassess, and evaluate the effectiveness of remedial action after a release has occurred.\n(2) The cabinet shall, by administrative regulation, es tablish standards and procedures\nfor the performance of corrective action in the event of a release of petroleum or\npetroleum products from a source other than a petroleum storage tank. The\nstandards shall adequately protect human health, safety, and the e nvironment. The\nstandards and procedures shall be consistent with the standards and procedures for\ncorrective action in the event of a release from a petroleum storage tank, taking into\naccount the differences in exposure due to the source of the release. The\nadministrative regulations shall allow use of the options established in KRS 224.1 -\n400(18).\n(3) Until the administrative regulations required by subsection (2) of this section are\nadopted, the cabinet shall allow a person required to take corrective ac tion in the\nevent of a release of petroleum or petroleum products from a source other than a\npetroleum storage tank to use the options and provisions established in KRS 224.1 -\n400(18) to (21). The cabinet shall approve use of the corrective action option af ter\nensuring that implementation will adequately protect human health, safety, and the\nenvironment.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=41568","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:38Z","sha256":"57381242b0e7992d6b9e9cb9f1e06c276db9b47006bca3ffc95d4cab7a008754","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.1-401","next":"us-ky/krs-224.1-410"},"notice":"GroundRules: Original legal text.
